Default Wilkys 1, CPS 0

Well, you remember some while ago I posted that my younger brother had been charged with GBH for landing on top of one of 4 blokes that pushed/pulled him down a flight of stairs and breaking the blokes neck.

This is second hand information I got yesterday.

First crown court appearance, adjourned for legal argument and as a result 3 witnesses were discredited as they had all been convicted of assaulting my brother in the same incident.

2nd crown court appearance adjourned for further investigation

3rd crown court appearance, request to adjourn denied. Are the CPS able to mount a prosecution, no. Case dismissed.

This is a lot of worry off him. He had to legally transfer ownership of his businesses and property to ensure his staff still had jobs in case he was convicted etc.

It would appear that the CPS were incapable of deciding if he had been pushed by the 3 on top of the stairs and went for the easy cop out of let the court decide. When the only evidence against him was from his attackers.

This really resulted from a "Special" who took the view that my brother was "uninjured" and arrested him when called to the assault. When examined in custody over 20 separate sites were identified where he had been punched/kicked.

So 1-0 to the Wilkies. Let hope it becomes 1-1 when I finally get my assault in court on Wednesday. Assuming CPS do their job properly this time.

sounds like a result on that one and dare i say it Common sense prevailing. Lets hope it still prevails for yours as well!
