Default Car Accident Issue



My Girlfriend has just got back from the shops. She parked her car in a car park on a slant and while she was in the shop a car has bumped her rear bumper causing her car to slide out of its parking position into the rear of another car. (she is in the blue car, but not at the time of the accident)

Both the grey and blue car owners were walking round the shop when the accident occurred. The driver of the red car drove off and there is no CCTV and nobody got the number plate of the red car at fault, but a shop worker has said that they saw it happen but can only remember that it was a red car.

The owner of the Grey car is acting like a **** towards my girlfriend saying he is going to claim from her insurance, she explained the situation to the Grey car owner and so did the shop worker who saw the accident but he is still acting like a stuck up ****.

My girlfriend is about to inform her insurance company of the accident, but does not want to stitch herself up as she has done nothing wrong.

Who claims from who ect???????? Any ideas?

Just out of interest, and I don't know whether you'd have a case on this basis but, what requirement does the supermarket owners have to ensure their carpark is safe?

Some contributory negligence may be able to be shafted onto the supermarket, but I'm not sure where she stands.

clearly, in a normal situation you'd all be claiming from the red car as it was completely their fault. If their actions had not have taken place, no accident would have ocurred.

However, because they've done, I wouldn't be surprised if Mr grey car did claim off your insurance and I very highly doubt they would refuse to pay out.

Im Sure one of our officers will be along with "technical" advice. SonInLaw had a similar one at Unesco's. Even on snow/ice surface would still need a good shove to start the incident "was it a set up" type claim?? do you have the grey car driver's FULL details, any photo's, witness details, have you reported to the police even though it is on a car park.

Just a few thoughts based on experience.

We swapped all details and took good photos of both cars and the car park.

I'd say basically a shunt, so the car at the back is liable. In the absence of that car I'm think your both claiming off the Motor Insurers Bureau.

I wouldn't worry about the guy saying he'll claim off your insurance, give him the insurance details (which you have to do my law anyway) and let him claim, I don't think your insurer will pay out so he'll be wasting his time, and his insurer will probably tell him that.

What I would do is get contact details for the witnesses, and name them on your claim form, so you have proof that you were not at fault.

PM TamSV and ask him to look at the thread, then you'll get proper advice. The boys in blue are not experts when it comes to insurance claims.

Report it to your insurance company and let them sort it all out, especially if your girlfriend has legal cover / legal protection as part of her insurance.

Dont enter into any more conversations or discussions with the owner of the grey car, just tell them that your insurance company are dealing with it.

A cyclist swerved in front of me, I hit him then I hit the side of a transit driving alongside me.

Cyclist ran off.

Van driver claimed off me, it went against me as a At Fault Claim.

Cyclists are not covered under the MIB, so I was left out of pocket.

So basically, Grey Car is in the right to claim from GF, her car DID hit his through no fault of his, no argument there.

MIB for her, were she will get a pittance.

He's still a ****! The shop worker told him what happened. Why is he being a **** towards the other innocent motorist caught up in it, who's in just the same boat as him? I can understand him wanting somebody's insurance to pay for it, but why hers?
