Default car insurance claim

I had a shunt on monday evening that wasn't my fault, I was taken from behind (snigger) and the bloke admitted it was his fault there and then. Obviously that means nothing in the way of liability. Anywho I got home notified the insurance ect and the ball was rolling.

Next day (yesterday morning) he rings me saying that he wants to go outside of insurance. I said its to late ect and I'd rather not as its not a cheap car ect and i want it done properly. He's adamant that he wants to go outside of insurance and even said to me "well I didn't give you my details so you can't anyway" I explained how I didn't need them as i had his reg insurance, company and contact information to which he sighed and said "oh yeah its on the database". All this leads me to believe that he is going to be a total ****** in regards to denying everything and dragging this out for ages.

Does anyone agree that bearing in mind I have call records, his business card and these texts

I've had the estimate done and its come back at a minimum of 1500 as he's pushed in the crumple rails. Although I verbally ripped his head off when I got out the car for driving like a **** (to which I apologized after he did) I have been polite and understanding up to now simply as I want this to go through smoothly but he is now really annoying me. I have spoken to my insurance and they have said its ok for me to tell this guy to **** off but its best just to ignore him.

Does peeps think the above info is enough to stop him arguing that he didnt do it? I can probably get a witness if it does go further as it happened outside truck yard with a few people present but thats not 100%.

Apart from being a c0ck he seems a genuine guy but something at the back of my head says he is going to try to riggle out of this as he has a 1700 excess

They try and riggle out of it. If you take the view that everyone on the road is trying to kill you and they want to screw you over you can't go far wrong.
Do you have photographs of the crash scene and witnesses?

Not sure but I dont think his excess counts for damage to third parties.

Its only an excess on damage to his vehicle that was his fault.

No I was so ****ed off when it happened I stupidly didn't take photos. I'm going to go back to the truck yard after work as they have cctv pointy at the junction where it happened so it should show something, if not the incident itself it will show us pulled over and swapping details plus there was at least one witness that it happened infront of as ghey swere waiting to turn out

Does anyone know if its illeagle to record phone calls? I could ring him for a simple chat and I'd have everything I need..... or is that againstg privacy laws?

Bwahahahaha! (Sorry, not laughing at you Wideboy. Laughing at that fool).

£200 for bodywork? What did he do? Lighting scuff an indicator? I've never known bodywork with anything less than a mild dent cost anywhere near that amount. Taking panels off, beating them out, welding the plastic, respraying, colour matching and blending with other panels etc. costs money. I've had 3 run ins with a bodyshop, and the quotes have been £600 to £3000, with various types of fairly minor damage. He is taking the **** by saying someone quoted him £200.

Secondly, £1700 EXCESS?!? Never in my life have I heard of such a ridiculous excess? Is he very young? Perhaps this is a new system set up to help young drivers get on the road and get their insurance down, but otherwise I would think that's a load of ******** too. Maybe £700, but not £1700?!? I've driven performance cars before, and on 'High excess' policies in order to get the premiums down, I've never had more than £600.

I don't know about your problems with legality, phone calls, etc. but you're doing the right thing going through the insurance company and doing it properly. He sounds like he's full of the brown stuff to me.

No he's probably mid 40's, brand new 1series beemer on private plate. Guess the moral is don't drive a car you cant afford. He was behind me for about 3 miles driving like a complete c0ck then slams into me at the roundabout. Pushed a hole into the bottom of the bumper and scuffed the rest, went for estimate last night and he said the bumper is binned and the crumple bars are bent on the bottom not to mention if the parking sensors are damaged ect.... minimum 1500 just for repairs

Mine is a 3 series beemer and they've booked me into a BMW specialist so that's going pricey enough plus the cost of my courtesy car which is a like for like

Spoken to the claim management and they've simply said if he denies it in anyway its going straight to court.

I THINK recording phone calls illegal without the consent of both parties.

(actually I'm not sure if its the recording thats illegal or the use of that recording i.e. playing it back for any purpose).

I know in a criminal court it would be inadmissable but not sure about small claims, you might be able to use it, theres not gonna be any punishment for taking the recording so better to have it and not need it than not have it and wish you did.
