Default OT - Short Hold Tenancy Agreements

My letting agency, being totally rubbish (putting it lightly) have neglected to provide me witha copy of this 6 months shorthold tenancy agreement, after i signed it and sent it back,

now i have had it with them, for various reasons, and i want out, sadly im only in the 1st month of my 3rd 6 month agreement, (you got that)

I am under the impression that i cannot jack it in at any thing less than the time left on the short hold agreement, i.e. the remaining 5 months, without paying the 5 months left upfront...

Does anyone know if it can be less than that, or will it state it in the agreement, that i inconveniantly dont have a copy of?

i might phone them for a copy, but today is the day they will get the letter i sent stating i am not paying x cost as i legally have no duty too... so they wont be very willing to help me.

additionally, does anyone know if there is a letting obardsman? as these guys need a real rocket up there ****...

Sorry to hear all this mate. Ive been in property for many years and the g/f is currently a lettings neg.

First and most importantly - do you have or know of a break clause?
feel free to PM me if you want to.

Sadly the law will regard your renewing your tenancy as acceptance of the tenancy contract... even if youve never seen it.

Are the agents a member of ALRA? (Association of Residential Lettings Agents) they will have the ARLA logog on the cards or letterheads if they are.

thanks mate,

i belive i read in the very first one i signed, stating that we are bound by each 6 month agreement, so were stuck untill december, this was sadly confirmed when i spoke to the agents thismorning, before the post arrive by the looks of things and they confirmed that im bound untill the end of the 6 months, i do however hope that the letter will **** them off soooo much they will evict us... that would be great

ho hum

just means i have to wait another month before i consider buing, to avoid paying rent and morgage at the same time!

Not sure if this is much help to you but here goes..

We were tied in to a 12 month contract. We gave notice in May that we would be leaving at the end of August. If the agent was unable to let the property we would have been liable for the remaining 6 months rent. However, new tenants will move in as soon as we vacate therefore they are only demanding £50 per month as a penalty - due to the cost of advertising, administration etc. Of course we are argueing that they would have had these costs at the end of the 12 month period had we choosen not to vacate early..

Dont e keen to get evicted mate, they could still chase you for the money you owe for the remainder of the contract. Saying that it'll take far longer then the remianing month you have for them to do that. Even under the accelerated eviction process.

If its only a month mate, stick it out. Easiest way.

They would have no basis for eviction any way, it was more they might request us to vacate early, because they dont like us?

its a matter of finding and buying might well take four months any way, ho hum, waiting game..
