Default Motorcycles and insurance claims

Hi, I kept thinking about a question for a while and couldnt manage to find an answer.

Basically Lets say you're riding your bike in the rain, and someone pulls out infront of you ahead. You obviously have to brake hard or try to swerve, If you brake hard and fall off your bike but have NO CONTACT with the car, who would the insurance company blaim? I can imagine this happening one day hopefully not (touch wood)

My guess would be, it'd be really hard to prove fault of the other party. They would literally have to hold their hands up and claim responsibility and tell their insurance company, which let's face it is unlikely. You'd probably end up having to claim on your own insurance.

Best bet is to smash your skull into their car to guarantee payment.

Yeah i guess it would, maybe we might come across someone who is kind enough to admit their fault and tell their insurance company.

You could also brake last minute to guarantee contact with the car But im sure this option will be painful or may even lead to death

I've always wondered, if you knew it was coming, whether you could stand up on the bike at the last second, let it plough into the car and leap over the top, then land with a tumble on the other side, but stand up fine. That'd be the ideal scenario.

If someone pulls out and causes you to crash it is their fault,but just like any road accident you would need to prove your case.
Realistically for that you would need a witness or cctv otherwise it becomes your word against theirs.

If the driver of the car stops (he could later deny seeing you fall off) they will most likely be apologetic and helpful at the scene. Try and record them admitting fault as once they think about it they will make a statement to say you were speeding, had no lights on, driving recklessly etc. As mentioned get details from any witnesses and check for cctv.

Agree with the last two posts - there's also a bike solicitors firm up here in Manchester area who proactively advertise for this scenario. They're called 'Sorry Mate' at the ads specifically state something along the lines of 'We appreciate that a collision between you and a car doesn't need to take place for you to make a claim."

Never used them though or known anyone who's used them, so don't take it as an endorsement...
