Default Filtering, Roadworks & Plod

So as many of you will remember, I asked you about your considered opinion for filtering in roadworks, especially when only one lane is open.

So this morning, I'm filtering quite aggressively, but always cautious.

As I'm filtering along, I see a police car, and the thought comes "I wonder what Plod will make of me filtering, should I carry on & risk it, or should I back off?" Now bare in mind I live in North Wales, and the police love pulling people over no matter who you are, a bike is worse. So I carried on

Filtered right up to the back of the police car, and followed it for a short while. During this time, a couple of cones had been blown over, so I kept tucking behind the police car & coming back out. When the time came, I passed them between their car & the armco, with loads of room available, keeping revs nice & high, with a little flash of full beam for good measure just before I set off.

I get in front, check my mirrors (thanks chewy!) to make sure it's safe for me to come back to the middle of the lane, and blue lights I manage to work out they want me to stop IN the roadworks, so I do.

"Have you any idea why I stopped you?"... Erm, I can guess So I get the usual exchange, them telling me what I did was clearly illegal, me asking for which act specifically states it's illegal. The fairly hot WPC (note: it wasn't a traffic car) tells me that it was dangerous driving under the Road Traffic Act, which I dispute because I made no-one to slow down or take evasive action. Next comes driving without due care.

To that, I respond by saying that I saw the cones, did she see me tucking in behind her & coming back out to the side? Yes. Right, so if I'm looking for cones & planning when I'm going to over take, am I paying full attention to the move I'm wanting to make? Did I wait until it was safe to overtake (and I made a point of not undertaking when I could of)? Also, I flashed my lights before overtaking, to try ensure she'd seen me, did she see my lights?

So long story short, I've ended up with a producer, which, whilst inconvenient, beats a NIP for a possible 9 points (driving without due care max points).

Big thanks to all of you's on the org. Without you, I wouldn't of been filtering, and would of been late for work. Also without you, I wouldn't of known what I was saying to the nice WPC Shame she doesn't know the parts of the law she was trying to enforce, but hopefully next time she'll remember (after asking a colleague for confirmation probably).

I've always wondered about this but never been sure if it was legal or not. Would it be legal if there was two lanes?
And what is a producer?

Producer is a document which requires you to produce documents at a police station of your choice within 7 days starting at the first stroke of midnight after you receive it. Also known as a HORT/1 it usually requests you to produce driving licence, insurance cert and mot cert as to not produce documents to a constable when requested constitutes an offence.

In my opinion, filtering is a grey area of the law and there is no specific law for the act. Unless you caused an accident through that, i doubt if many cops would want to take you to court over it as it probably would be thrown out

tee hee the two times i have had a Horti i have waited until the last five mins to produce em.

well they want to inconvenience me why the hell shouldn,t i be arsey about it.

one was for sitting on a double yellow line for 2 mins while my mrs came out of work. the other was for being 2 up with l plates on the bike (was a mates bike i HAD passed my test, and was insured on his bike) anyway i digress

Good job, good balls. I hope they get re-edumacated.

Did they actually say 'you may be prosecuted for these offences' or similar as they need to if she wants to follow it up and arrange to send you a summons through the post after due consideration of the 'facts'. I believe they also need to caution you pretty much immediately after asking your name and address as any other details you're giving are statements affecting your case etc etc. Did they do that?

What will you you do tomorrow when you come across them?

I would arrest you for not wearing a seatbelt......

why?

because;

1) i can

2) because i would be dead jealous that you were on your bike and i wasn't

3) because i have nothing better to do, and i should be out catching real criminals

Got one of these after mu off - went in 9 days later - having called the issuing forde (I needed to get a duplicate cert - couldnt get to my original due to Broken Collar bone (buried under boxes))

If everything is in order it is aparently next to unheard of for them to prosecute anyone for being late producing - or so they said....

Certainly nothing was said to me when I went in with docs

Nah, it was more of a general chit chat, it was pretty obvious she was sketchy on the laws, but like I said in my original post, she was no traffic officer. I don't know EVERYTHING about my job, so why should I expect someone else to?

Tomorrow, if I find another police car, I'll be hoping it's fraser01 Just for the giggles If it's not him, I'll still filter when safe to do so.

Btw fraser01, before now, I've been merrily plodding along down a dual carriageway & thought "oh sh*t, I haven't got my seat belt on".... "oh, wait, I'm on the SV, not in the car "

I'll take my documents with me tomorrow, and if I get pulled again, I'll have the documents Then I can sort the producer.
