OK.....
The wife is driving the car home tonight on the York bypass and a car in front of her slams all on, forcing the misses to slam on. On doing this she hears a crash and a bang. Getting out of the car there is a bike laid in the road and a biker sat on his ar3e. (it was an SV1000 ironically). Adament that the bike has hit the car she asks him for his deatils and sees a slight damage to the back of the car. On asking he turns round and says well actually I am not insured because I just picked the bike up as new. He is adament that he missed the car though. A witness who has pulled behind him said he was riding very aggressively when he passed her and was a acting like a bit of a loon. I haven't seen the car yet so I don't know how bad the damage is. Also wife didn't have a clue what to do at the scene of an accidentand she is 6 months pregnant so a bit scatter brained. ( so could have been a lot worse). She did have the good sense to get his details Bike reg etc etc. Also got the details of the witness. Personally it sounds like he was trying it on. Question is what do you do? Report it to the police or what. He openly admitted driving without insurance. Also whenever I have picked a new bike up before they insist on insurance to tax it. Just seemsa bit like 2 + 2 = 5 at the minute. |

I'd report it to the police, get a crime number.
But if he isn't/wasn't insured, you'll have to take him to court yourself to reclaim costs i guess. |

The wife is sure she felt the thud of either of the rider of the bike hitting the car. The car in front shot off without stopping. Only got the details from the rider and the witness behind. |

if there is damage report it if not save yourself the court palava depending also on the damage - send me a pic and I'll tell you how much you'll need to make it right |

Its rubbish. When i picked my k6 up i sent a certificate of insurance to the dealer. They were happy with it, but Suzuki weren't so i had to send more info off. Even a lax dealer wouldn't have the option of letting a new bike out. What a *****.

The rider said it was from the York Suzuki Centre, which is a dealer in York.

If the rider has no insurance then you report it to the police, they will investigate and they will take him to court re driving with no insurance, driving without due care and your misses will get compo.
If from the criminal court she doesn't receive it then she can then take him to the small claims court, First she HAS to report the accident and give the police witness details, they will do all the work. The Police should give her advice when she reports it and explain the procedure. Why should we all pay insurance and he not? What happened if he wrote her car off?

I have to agree with the Woozle here, lack of insurance in my mind is one of the biggies. We all make mistakes from time to time and it's only luck that keeps us from doing something truly horrific to someone, inflicting years of hassle on a now wheelchair bound victim because you couldn't be bothered with sorting out insurance is not just criminal, it's plain wrong.
Insurance can be easily sorted out nowadays, you don't need to arrange it a week in advance, it can be done over the phone hours before you actually need it. |
