Ever so glad you walk away from this one SoulKiss, especially as it was one of those Urban Tanks.
![]() However, and I hope I'm wrong, the first question his insurance company might ask is "What were you doing undertaking a car indicating left?" She may well have not been aware of you and had stopped, not to let you past, but to allow the RR across the road. Also, maybe, you were more focussed on her not coming across you rather than looking ahead and observing more of the road. Ok, her positioning was all wrong as the Bus lane was not in force, but I think the insurance company may well think you were partly responsible for the accident. Sorry for playing Devils Advocate, and I hope I'm talking out of my ar$e. |

So it was the woman who was in the wrong lane - and in that situation I have the right of way. She was aware of me, as she stopped instead of turning across, but I will concede I was paying a LOT of attention to her - its because of the "will she turn" that I was already slowing, expecting her to go. Also if she had stopped/flashed the RR to cross, well its not her responsibility to direct traffic, and he should still have paid attention to what was going on. Insurance co said on the phone that it sounded like a no fault claim, and I wont be accepting anything but. All taken in the way you meant mate, but its open and shut. There are also 2 witnesses to it - one was the driver that stopped, the other completely not involved as he was putting petrol in his car at the garage, and is, a biker. Both of their details have been passed to my insurers.
