The article Hovis linked to says that the judges decision was made in 2006, and by the sound of it, it applies fully to you (usual not a lawyer disclaimers aside). Might be worth talking to the solicitors and reminding them about this case, as they might be going on the 1972 case as precedent.

Standard response, if your solicitor is any good he will already know about this judgement and lurking somewhere on here (or someone will have a copy) is Lynw's letter about just that sort of thing Unless you really really have to accept nothing less than 100% against other party, may take a little time but you will also be able to claim back a lot of the extra premium as well

No not really the case, but I had seen it mentioned before so it was not "News" as you purported it to be.....

If I have to go less than 100% it's not worth it as it's £7o0 a year up on car and a couple hundred on the bike. I'm just waiting it out, ready to go to court if I have to.

this has been around for ages, speak to your solicitor and if they won't press your point then get another, they work for you

white dalton seem to get a good rep but i've never used them

Thanks for posting. I'd missed the other posts (dig at duplicate post nazi's ). Now I know why my case suddenly quickly in my favour once the solicitor mentioned the shrogin case!!
