I'm losing any of the little faith that I had left in the justice system here

Do NOT pay the recovery or storage charges, do not enter into any negotiations, and do not make any admissions. Get some proper legal advice off a solicitor now.

The only reason the Inspector is saying they may not prosecute you is he knows full well he can't. He also knows that if you don't pay the recovery charges he will have to explain to someone why they have to.

Make sure your solicitor asks them under what power they seized your bike, and under what power they tested it. Then ask them to ask for full disclosure of all the evidence before making any comment to the police. This disclosure should include the specification and calibration of the dyno and it's approval for such use. Do not under any circumstance roll over and do any deal. You will be letting yourself and everybody else down by doing so.
What he said.

FB, If Red H says do x,y,z then that is exactly to the letter what you should do. Never mind any waffle that anyone else on here says, good intentioned as it undoubtedly is, or any waffle you get when you go and pick the bike up. In truth what ever that Inspector said to you its complete rollex. I'd bet money you have them over a barrel. I'm not suggesting you shaft them coz that will just get messy but there is no reason for you to hang back now either.

Listen to Red Herring.

I'd be wanting proof of what they are saying is true, i.e. a Dyno Print out from the dyno they tested it on.

Then I'd want an independant dyno test done of my own.

Something smells very fishy here, why on earth would they let you ride or take the bike away knowing that is illegal for you to do so if it is as they say putting out 70bhp...

LEGAL ADVICE GO GET SOME NOW. Most places might do the first consultation free. That would probably be enough to get the inspectors sphincter clinching if he is in the wrong... Have you not got parents or a mate who can help you out if you are short of funds. Hell I'd stump up a few quid just to see this put to bed properly. Because the whole thing stinks IMHO.

Listen to the fish!

You're being stitched up good and proper here. Like fook it is 7bhp over, if it was they would be charging you with "other than in accordance" I'll bet.

As said, they now, apparently, know its 7bhp over, so they have you bang to rights for having a non 33bhp bike, yet they are telling you to ride it home???

Its either because they knwo they're stuffed, or so they can actually do you for it.

Follow the advice given, I would.

Where did the 6 points for no insurance come from? No need to worry about that - there's no way your insurance is invalidated in these circumstances. No semi-reasonable insurer would try to get off this and, if they did, the ombudsman wouldn't wear it.

You've taken reasonable steps to make your vehicle compliant. This situation is not the same as just deliberately riding an unrestricted bike.

If a well respected Copper is telling you to not accept what they are trying on with you then (parden the pun!) something smells very fishy
