I have been following this thread with avid interest since last week!
The more farcical the whole thing gets, the more my blood boils! Like most people, I simply cannot belive how this whole debacle has been handled by Warwickshire Constabulary. Unfortunately as well I can't really believe how FB has seemed to bend over and take it up the arris. Accepting whatever the police say ![]() This is in no way a personal attack on you FB, I really feel for you and expect all you wanted was your bike back! I can imagine it takes quite an assertive person to stand up to the police in a way that would get the results you desired and to be honest I'm not sure how I would've handled it, but would have drawn the line at paying to get my now damaged bike back! This whole episode stinks and seriously hope that it will finally get resolved to your (and all of our!) satisfaction ![]() |

Folks,
The main players involved in this are not back on duty until next week so don't expect any significant update until then. Having spoken with the OP I'm reasonably confident this can be resolved so I would encourage people to keep their powder dry so to speak and not up the stakes to soon. |

I'm in the same boat with a restricted K4. I made loads of calls and sent numerous emails to all the respected offices to find lots of confusing messages. In the end I called my local constabulary and asked for the law. They called me back after a day or so. I was told to get a certificate from a dealer that would verify the power output of the bike. I did this and paid £25 for the check. I should carry this paper around with me all the time to produce as required. I have not had the pleasure of using this to date, so good...but I will have to next month, when I attend a Bikesafe course. I'm sure all will be fine....

Hi all, i have been following this thread from the beginning. The only thing i can add if the OP is prosecuted and gets a summons to court, which would be the only way he would get to court in this situation.
Flameboy would be entitled to disclosure which would / should contain a copy of the Dyno report, exhibited by the operator including his experience and calibration of the machine, statements from the officers in question detailing why the OP was stopped. If the OP is summonsed to court and cannot afford a solicitor all the points raised by members must be raised with the prosecutor in court. The magistrates will not convict without these matters being investigated and put the onus on the prosecution. Answers to the questions may not be forthcoming but due consideration will be given whether to prosecute in all the circumstances. When / if the prosecution decide to discontinue this matter the court should be asked to award costs that have been occured. That is if it gets this far. |

Good on RH for the assistance, top job. I'm sure we all really hope this gets resolved satisfactorily and some respect for the force can be retrieved. As in my previous posts on this, I don't know the ins and outs of either the law nor Police procedure, so apart from the astonishment at what's happened I'll refrain from comment. What I would refer back to, just in case the point was missed, aside from whether or not they had authority to do what they did, if they want to measure power to any standard which would be admissable or even worthy of consideration as evidence, it would have to be done in accordance with the appropriate test procedure at an appropriate facility by appropriate personnel. My question would be simple - Was this test carried out according to the appropriate test procedure? If the answer is "no", then end of story, if "yes" then get the details of what test procedure was used and all the data which must be recorded according to that test procedure. I would still wager a pound to a pinch of sh1te that a rolling road inertia dyno would not be appropriate. It would be akin to being done for speeding based on someone pacing out 100 paces and using a stopwatch, or sniffing your breath and declaring what your blood alcohol level is. If it isn't done to the right procedure with the right equipment it's worthless, that's it. Good luck mate, you've got some good help by the sounds of it.
