Flameboy.....have you confirmed that the police have your bike and what they are doing in terms of a receipt??????
If not, I'm not being funny mate, by WTF are you still doing here / sat at home!?!?!?!?!? Someone has taken your bike with no documentation given. You NEED to go down the police station now.

Ah yes I see that now on re-reading. Stopped by the pavement on the bike, chatting.
Why didn't they check his details when they asked him to ride off? Why wait and stop him later for that? Hopefully he's at the copshop now trying to sort it out |

I smell a big rat...
Surely if a Sargeant was involved the necessary paperwork/forms would have been issued!? In my synical, suspicious view, I'd say there is a distinct possibility that these were fake police (not meaning PCSO's ![]() I would always ask for ID from a copper, especially if they're in plain clothes, but best to be on the safe side. And I'd have definitely asked for some sort of reciept as to where my bike was going. THIS IS NOT GOOD. |

visited the police station last night, still no official paper work just a few numbers to contact the officer and a crime number scribbled down. I just got off the phone with the police officer who pulled me and he said:
"the burden of proof is on me to show that the bike is restricted, it's not for the police to decide" The reason the bike was seized: It's a 650 and i couldn't prove it was at the correct power output for my license He now says, a certificate or plate is not required by law but if stopped by the police you should be able to prove that the bike is restricted (a vehicle inspector told them about the "plate" REQUIREMENT.. that does not exist) SO, it's not a requirement by law but if stopped the police can seize your bike for not having one? Great. and I received no paper work because that would allow me to get the bike back, and that's not going to happen until he has had it tested, he thought he'd given me contact details and when i said he hadn't he went onto saying "you were talking to me for an hour and I'd assumed you'd taken my number and name from my uniform" Waiting until Monday now when they test my bike, or should i be going back down to the police station? My first run in with the police out on the road, I'll be making sure to check a few things next time this happens. Last edited by Flameboy; 25-04-10 at 10:39 AM. |

Personally.....I would still be wanting to speak to his superiors. That is not acceptable in my view.

If a vehicle is seized, they have to give you a reciept, listing all damage (if any) on the vehicle at time of seizure. (Met did this on a mates bike). All they had to do was check you owned it, it was insured, legal to be on the road and give you a producer. The date stated on restriction certificate would obviously have to be prior to you being stopped. If you go down to the police station with proof of restriction, surely they have to release your bike. How are they going to check it's restricted? A dyno? What if they damage your bike when dyno-ing it? You need to get legal advice like NOW! |
