Perfect, that means if they have pic of it parked hanging out of the private area, the traffic warden must have done that to front end pushing it back in!

did you appeal before recieving the enforcement letter.
as my understanding with most boroughs, is that you can only appeal after the letter. it has about appealig the charge on the right hand side of the letter. send them as much proof as you can, with pics, etc. good luck ![]() |

good look with that one if you know anyone local with black pointy that you can park there to photograph (remember to swap the plates with yours just for the photo) then use it
![]() i remember me and my mates all got tickets for parking in one car bay each 18 bikes - 18 bays - 18 tickets filled the small car park, they didnt want us parking on the pavement so we did what they asked ![]() |

You are aware that a public right of way can be on private property aren't you?
A "road" extends from hedgerow to hedgerow (or in this case probably the building line) and the pavement or footpath is normally part of the road, but not necessarily the carriageway which is the bit you normally ride/drive on. The ownership of the pavement is not in dispute here, what they are saying is that your bike was on the footpath, which is a public right of way and therefore part of the road. If you think of footpaths across farmers fields they are running across private property, yet they are still "roads" within the definition even though they only have a right of passage on foot. Psycho... wait till the pics arrive and then PM me about this mate. I dunno if you know but i help a lot of the Soho-ers fight their tickets and most are won faily easily if they can be won.
Yours, even tho there is a plate on the floor is still a greay area one believe it or not. Westminster for example would reject it out of hand and argue "if the public have a right of way without anything physically restricting access. then no signage matters" , sucks right? I'm not sure about City ones tho, never had to contest one of those before but the law is pretty much the same in most places tho the City does have its own peculiarities.

Nice, I remember some winker complained about my bike taking up a parking space at work. I just replied that i pay road tax so **** off.

We had exactly the same issue where i work, about a dozen or so staff ride into work and were in the habit of parking their bikes up against the building wall rather than in the body of the car park. Some so and so manager raised it as a "Fire issue" saying the bikes near the building were a danger so directed everybody to park in the bays....in a car park that was already overflowing! Needless to say we all did what we were told, in fact we were so efficient that for a period of about two weeks every time that manager arrived at work there wasn't any space available for them to park. Their solution, they marked a bay up for their exclusive use!
You know those unregistered, uninsured old bangers the police keep seizing....guess where some of them keep turning up! |
