I have just spoken to my little bro, who is a qualified MOT tester.

He said that it could fail if the tester decided that in his judgement it interferred with the operation of the tail light.

There is no rule for the distance between indicators, they just have to be either side of the vehicles centre line.

although when you think about it, when one side is flashing amber, the opposite side would still have a row of red LED'S illuminated whether on just the tail light or if the brake light was in operation, suppose it could be up for debate though since as you say, its down to the judgement of the individual tester (although they do work to rules, some stuff like corrosion could be viewed differently by different testers)
