Cooling off only applies to new customers, as i've renewed my contract - and opened the new phone, apparantly there is nothing they can do. Unless once they listen back to the recorded conversations and it proves them wrong.

At which point I'll be telling them to stick the whole thing up their bottoms. lol

Looks like I may be able to get the voice guidance for "free" anyways, after a little poke around some websites. hmmmm.

You sure they not just telling you that.. as I thought as its a new contact you are a new customer in the eyes of the consumer law. Regardless what they might say...

My contract was up for renewal with three, so I called them up to see what phones I could get - as you do.

I'd seen the Nokia 6220 Classic on their site - that supports GPS and comes with Nokia Maps. Hmmm, thinks me, that sounds pretty good.

So while on the phone to 'em I asked if there were any charges to use the sat nav. To which I was told there is if you download local data etc, but not to use the pre loaded maps. So I went for it.

I then called back again to confirm there was no charge for it - again, yes to download data, but not to use preloaded info.

Sooooo, reading last night, the phone comes with 3 months free of voice guided navigation, after which you go back to Nokia and buy it again (1 month, 3 months etc....). I wasn't told thisw ehn I asked about charges. Without the voice navigation, the actual navigation side of things does not work - you just get a nice map that follows you around.

On the phone today to get it swaped I'm now told that because I dodn't ask the very specific question of "is there a charge to use voice guided navigation" that I can't swap the phone.

Grrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr

So I've told them to go and listen to the recorded conversations, and they are calling me back. I'm not holding out much hope.

Sorry to rant on folks, not something I normally do - but this has got me wound right up.
write a letter send it back with the letter.. cancel your payment and move on..

they wont cry about it...

Well that's what they told you - I'm not so sure that's true. Worth looking into I reckon.

Where's Ed?!

From their site...

http://ask3.three.co.uk/SRVS/Data/Hu...eb/retail1.htm

The returns policy doesn’t apply:
· to new customers who didnt buy their mobile via the telesales team or three.co.uk, or
· to new customers who bought their mobile via the telesales team orthree.co.uk but have used their mobile. This means that you may not personalise your mobile in any way (including inserting the SIM card and switching the phone on), or use any of the 3 Services, or take photos or videos or load any data onto the mobile, or
· to existing customers who upgrade their mobile.

Have a look at this - Cooling off periods - and a search about, but even renewals have cooling off period.

Quote:
The purchase of goods and services over the internet, by phone or by mail order generally is subject to the Distance Selling Regulations. One of the most important implications of these regulations is a cooling off period of 7 days during which you have the right to cancel. You must provide notice of cancellation in writing and it must be posted to, left at, faxed or emailed to the business address of the supplier, and you must ensure this is done no later than 7 working days after receipt of goods. Contracts for financial products sold by distance means are subject to diufferent rules, see below for mroe on this.
