I then employed a temporary driver who had the situation made clear to him that should the other party wish to return he had to go
After another 10-12wks the former employee phoned up saying he would never be able to do his original job again and thanked me for keeping it open.
The temp driver was good at the job and over the moon when told it was his permanently if he wanted it
I feel it is all a matter how you approach the situation and how understanding your employee is.
Sounds like the most sensible and fair approach

How is this anyone but the bloke in questions concern?

You cannot be responsible for what anyone else does.

26 weeks m8. Then you can let him go. Thing is though do you not claim it back from your employees tax and N.I contributions. We have an employee on the long term sick and she only costs us about £10 a week when you deduct it from the quarterly payment.
PS meant to say, phone the employers helpline 08456070143, they will help you all the way with any legal issues regarding this.

Agree, I'd still feel bad though.

Mr D...call the Acas helpline mate. They offer free advice to employers and employees alike in these situations.

They were the most helpful resource i found when i was considering taking my previous employer to a tribunal.

Its an 0845 munber and the advice is free, confidential and impartial.http://www.acas.org.uk/index.aspx?articleid=1461
