I put the greater degree of fault down to the 4x4 driver --mirror, signal, maneuver if SAFE TO DO SO.[Observation]

id suggest its not entirely the bikers fault, the 4x4 man pulled out without checking. that said im not sure what the rules slash laws are on filtering.

from a legal standpoint I would agree that blame can be apportioned amongst both parties. But from a riders perspective he had total control over whether or not he placed himself at risk of this happening.
As a rider I think you should take control of your own vulnerability where at all possible. Filtering is a risky activity, especially at speed and every rider should be aware of that. This was an accident just waiting to happen. |

I'd say the 4x4s fault, but completely foreseeable/avoidable from riders perspective.
