They cannot stop you taking it away, you wont get done if stopped by the police provided you have the failure cert and are riding the bike home (directly) or to another shop (directly) to get it fixed. Ditto riding the fixed bike back (directly) to the MOT test station provided its booked in, don't go the long way cause if stopped you will get done for no MOT, no TAX and probably invalid insurance
