My understanding is that your insurance company will only see it as a non-fault claim, when they've been able to recover their costs from another party. That's unlikely to be the case.

I think the only similar case was a few years ago with Moriarty, who crashed when a pedestrian ran out infront of him. I think he was able to sue the person for his costs in the Civil (or maybe Small Claims) Court.

Unfortunately you don't have a cyclist to stick in the dock.

I'll ask Matt what happened with him...

The key thing is that fault is not the same as claiming - it's no-claims bonus not no-blames bonus. You can have a no-fault claim (hit by uninsured driver - or cyclist in this case!) quite easily, but still lose your no-claims bonus because you chose to claim.
I think there's a lot of confusion between blame and claim on this thread (and in general, actually).

This case is a little more difficult in that it is someone else claiming off you. I think it needs to be established what the law (?) says about the claims procedure when a third party causes you to hit a second third party.
If the second (innocent) third party would normally claim off the original cause of the accident - the first third party - then the van driver should not be able to claim off you.
However if the claims procedure would be that each party claims off the party that directly hit them, and the claim amount snowballs until it hits the original cause, then it will mean you'll have to take that claim.
I don't actually know the answer to this question, but it seems Dave has done some digging as he mentions the negligence aspect. Hopefully it will work out!

Boils down to what insurance company you are with. Mine don't charge me for no-fault claims. Others apparently will.

Tbh that question should really be put as "Why does my car insurance premium increase after a no-fault claim on a third party's policy?" - because of course you can claim on your policy when you are not at fault (if FC)...

Got "The letter" from NIG

"After reviewing your comments, we have to advise you that, although you were not the causation of this incident, as the cyclist has left the scene and we do not have their details, you will be held at fault for this incident for colliding with the third parties vehicle. We will therefore settle their claim after 21 days."

Now is it just me but how can I be held at fault when they acknowledge that I did not cause the accident?

Did I learn a different version of English or something?

I think you may find that "at fault" in insurance terminology isn't the same meaning as the layman's definition...

And what that letter is actually saying is "becausee we cant screw the guy that screwed you, we will screw you too".

Call to the Insurance Ombudsman in the morning I believe...
