I guess it's fraud maybe, he obtained something by deception?

Surely they'll have his reg on CCTV, thats assuming they figure out how they c0ck3d up and report a crime though.

To avoid "theft by finding" you would need to show that you either made all reasonable enquiries to establish who the owner was, or that any such enquiries were impracticable (like standing in the middle of the High street and shouting "has anybody dropped this tenner...)

It's usually fairly obvious who a bin belongs to, as it is that the McDonalds belongs to the car behind you!
