This is really simple - each vehicle (or its owner/insurer) claims against the vehicle that hit it. The grey car claims against the blue car. The blue car claims against the red car. The grey car has no direct claim against the red car - the blue car would claim the cost of the grey claim from the red car as a consequential loss. If the red car can't be traced, the blue car is stuffed.

Sucky for Miss Blue, but that's how it is.

i have renewed my car insurance twice since some one reversd in to my car and did a runner,and it hasnt made any differance to my premium even when i changed companys to get the best deal

Thats the way it works, you claim against the person who hit you.

Pains me to say it, but fizz is right.
In a situation like this, the car in from claims off the car behind and likewise if there are other cars in the line behind.
Yes it's crap and unfair but that's life and what we pay insurance for.

Go try do 2 quotes, pick a comparison site.

Quote 1, car, 5NCB.
Quote 2, same car, 5NCB, 1 at fault claim.

See what difference is.

I didn't realise that the car in the middle has to pay out if the car at fault can't be traced, and not the way it happened when I got shunted either, both cars claimed directly off the car at the rear (who of course could be traced and was insured), so I'm going to take that with a pinch of salt until someone like TamSV confirms it anyway.

It doesn't change the fact that the OP's GF should be able to claim her losses from the MIB if the gray car sucessfully claims off her, and it doesn't change the fact that the OP's GF was not 'responsible' for the accident.

It certainly doesn't change initial post that started this debate. The fact that the guy was giving the OP's GF a hard time about it despite her having done nothing wrong and he's being a ****!

That would possibly happen in respect of a multi vehicle shunt when there is no clear evidence of who was at fault (ie if there were a number of collisions causing the pile up, rather than just the car at the rear pushing everyone into each other!).

In this case it is a simple matter of legal liability. Both the owners of the blue and grey car are innocent, neither have caused or contributed to the accident. As there is evidence showing a red car pushed the blue car into the grey car, why should the owner of the blue car be penalised? The fact the red car cannot be traced does not make the owner of the blue car liable!

Call me a sceptic but how did the grey car get in and out of it's parking space (up/down hill) if the car park was so slippery that a car was able to slide at least 20 feet with it's handbrake on after such a minor impact that the other vehicle only left some red paint? You can take offence for me asking if you like, but it's the first question the insurance company is going to ask you.

What I was thinking. I don't think this is one of those set up claims though. The money on those is made through the driver and passengers of the lead vehicle claiming for loss of earnings, medical etc. There was nobody in the cars that have claims here so very little money to be made out of a set up.

It sucks, but Fizz has it right as far as I know.

ill try that one one day,when i next do for renewal,but i can only say as i find,and insurance goes up every year,blamed on bad weather etc,but in mid 2009 i was paying about £200 fullycomp including buisiness use on a 98 mondeo(about a 1k car),in 2011/12 i am paying £250 on a 2005 mondeo (about a 3k+ car)for similar cover,and the old mondeo was wrote of in dec 2009
