To be honest.... i'd do it to him if i was the guy on the bike.
And then drive off and expct no more than what he got as my punishment.

Its the judges that need to live in the real world. Would they accept this as justice if the man who lost a foot was thier own son?
Or even one of thier pals from the gentlemens club.

£300 compo for losing a foot?
i've had bigger demands than that from local councils while arguing a parking ticket FFS.
Is there no sense of relative scale in this world?

Just been reading about this on The Nest and on the Foccer's site. The biker was a Foccer and they are incandescent at bothe act itself and the sentence meeted out by the Court.

The Foccers have been using the "Fax your MP" service about the sentence and the driver is a constituent of Jack Straw's, so he's had a few letters. As fellow bikers, we should, IMHO, should support our two-wheeled comrade and do the same. 2 months in jail (he'll serve about 3.5 weeks) and £300 comp to the victim is outrageous.

Maybe those on here from the Blackburn/Read are could contact the local Foccers and Hornet riders and have an organised protest ride - there's talk of it already on the other sites. If I lived nearer I do it myself.

Turns my stomach just thinking about the incident.

This is nothing short of disgraceful. The ever increasing number of low lifes driving around without insurance or any regard for anyone else sickens me.

We've just had another one locally. Biker was killed after hitting poorly repaired road surface. The H and S executive actually investigated (amazing in itself) and took a case to court. The agency responsible for the road repair (it was actually the water board who had organised the road dig up) were fined £1600 but with £3000 costs!!! So it is more important to make sure the H and S gets its costs back than the facts someone was killed is recorded. It just seems all wrong to me.

Sounds like it was a case of negligence against "the body corporate" rather than specific individuals or company directors. If the HSE had thought that the workmen had done shoddy or substandard repairs upon the instruction of "the controlling mind" (i.e. the boss) then they'd have had the boss up on a charge in person.

The judgement will allow the family to claim compensation against the company involved in a civil action with some confidence.

We find lots of seemingly poor judgements in the environmental/H&S field, e.g. fly-tippers being fined less than the cost of taking the waste to the local dump, etc. Very frustrating.

The problem is that the maximum fines for these offences haven't increased for about 15 years, e.g. a "Scale 5" maximum fine is still £5000, same as it was in 1990. The max fine (per offence) for H&S or trade/business offences is only £20,000. It's unusual to get maximum fines for a first offence even though the offenders usually do their nefarious acts in full knowledge of the law.

i would cut the car drivers foot of then bankrupt the wa##er and give all the money to the biker. thats justice. i am not extreme just following the bible

This just shows how crap the British Justice system can be. Some of the sentences handed out to reckless car drivers are disgraceful at best, it seems if you really want to kill someone then just use a car and make it look like an accident, typically the sentence for this would be 12 to 18 months, where as even manslaughter is a lot more. The £300 compensation is also a joke as the biker will lose £300 when his claim goes to the MIB, they take £300 from the victim off the total claim as part of their terms, and this should be considered in any compensation awards dealing with road traffic accidents. To make matters worse it seems the driver is going to appeal against his sentence.
