im very sorry to hear about your unfortunate accident, bit of a sad story, like you said, he was only trying to help, and the results were not his intensions, most people would have sued, but thats quite honerable of you.

lol, yes, lesson well learnt..... try to make sure i am always visible to other drivers. the fact that my bike is bright yellow and i have a rediculasly loud exhaust also helps on this point, but alone... not enougth

I'm not advocating the money grubbing ambulance chasing litigation that we hear is rife in the states, I just want to let the insurance system run its course. Old Jack was in no way alluding to 'punishing' anybody. Where did that drama come from? He was just suggesting getting the other guy's insurance to make good the damage done to our guy's bike and body - if any. Why the hell should our guy have to break his a*se faffing around for bits and pieces? If that had have been done then the bike might have been sorted with new parts by now. Just finally: The other guy was insured presumeably so how is he being punished? Some percentage of his no claims bonus perhaps? He hit a biker. John |

Thanks for that support ejohnh, I was still smarting from having been ganged up on by the "I don't think we should claim for injuries to ourselves even though we pay through the nose for insurance to cover just that eventuality" brigade !

This guy was offered the oportunity to settle privately, and took it, that surely begs the question why? Maybe he considered that paying privately was cheaper. Afterall, if he'd of wanted to push this, adam_castell has clearly said that he was partly to blame, as he was out of sight of the driver that ultimately hit him. Is it really worth all that extra hassle, and expense, just to see "the system run it's course"? IMO, it's not, and if avoidable, should be avoided. Just my 2p |

I'm just glad you came out of it unhurt man!
Just sort the bike and let the bloke pay for his mistake. He's a decent fellow you say so he'll be happy to make things right. If he was different you would have rightly reacted acordingly. But do get a check up. If you have something which will show up later it wouldn't be fair that you'd have to pay for it. That's why there's insurance. If you're sure to be ok, after checking, then go as you are. Unjust claiming will eventually be paid off from higher premiums in future. So lets all be wise and take what is ours but leave alone what's not. |

am i partly to blame??? i can try my hardest to make myself viewable to other drivers, but he should not have pulled out of the junction even by one mm until the other car was out of his view, instead of waiting till he had a clear view of the road, his car was half way out as the other car was half way off the main road on to the junction. even if i was in a car, he would not have even seen me, just because i was travelling in a smaller veichle, does not make it my fault at all. in my opinion, i had no part of the blame.... yes, i could have avoided it by increasing the space between me and the car infront, or by walking instead, but this would not have altered the fact that the other driver pulled out on to a busy main road with out clear view!
