Silly question but surely the standard ECU and the restricted ECU are different part numbers,this being the case it is not difficult to prove the bike restricted------------Sorry but somebody is either telling porkies or extracting the urine,or being a muppet.

One very easy question and one piece of advice.

Were the officers who stopped you and "examined" your bike in uniform or in plain clothes?

Next time you speak to the police ask them to tell you under which piece of legislation the officers examined your bike (they had to look for the "plate" didn't they) and under what power they seized it. Write down what they tell you and let us know.

Providing the two parts have different part numbers and the correct part,part number is fitted the worst scenario can be its a defective part if producing more than 33bhp.
How is the original poster to know that it is defective,yes a dyno you say,but a dyno run can be done on any bike not necessarily the vehicle in question.
I would be more inclined to go down the part number route as this is irrefutable evidence that the OP was genuinely under the impression the bike was restricted
and a solid defense should it be necessary to go to court as implied in a former post

BTW....you can(well certainly in my case) have Legal Assistance on your bike insurance, go and bleddy use it if you've got it!

As I've tried to say several times I'm fairly sure the officers, even in uniform, have no authority to examine your ECU at the roadside or in these circumstances to seize the bike to have it "power tested". It may be that I've missed something which is why I've asked the OP to find out from the horses mouth so to speak what authority they think they acted under.

No they were in Black uniforms, Tactical response or something (with guns).. This is one of the questions I've been trying to get answered over the last few days, but keep getting passed onto the next person. I've kept a record of every call and everything that has happened so far so I can use it against them or in my own defence.

They didn't examine it, they asked if I had the "plate" I said no, They've then taken the above (back a few pages) actions.

Where would I be able to check the part numbers? As i have the original ECU (unrestricted)

Wtite a letter to your local MP.

Acctually, I wonder if you could get an ASBO againts this officer. His actions have left you bikeless and thus means you can't be social. Also, I wonder if there's some sort of human rights infringement. I hate this sort of crap, but what sauce for the goose.

Multiple officers in black with guns = intimidating. Lose of your bike, all this stress and hassle = destroys your quality of life.

Also try http://www.ipcc.gov.uk/ Police Complaint Commision.

Basic human rights include. The right to liberty and security, to a fair trial and to no punishment without law. (key points being they've taken your liberty without fair trial and that you've been punished without law, i.e not law to have a special plate or certificate and you've been punished.

As much as I hate them, I'd get MCN on the case - things start moving as soon as there's a threat of bad press for the local force. Firstly though call White Dalton Solicitors and do exactly as they say (you have a link to their website) here's the freephone number - 0800 783 6191.

If WD don't want to know (and I can't see that they would be anything but helpful) get down the station and demand to see the duty Inspector immediately. Go armed with the part number for the restricted ECU and the phone number of your local Suzuki dealer's parts department, take the unrestructed ECU with you so they can check the number of the ECU on your bike against what Suzuki say.

Have you got a local paper? Take one of the journalists down with you to record everything and make sure the duty Inspector knows exactly who they are and why they are there with you.

Flameboy - please phone a solicitor/lawyer/insurance legal helpline now! Try White Daltons as a first port of call. And phone your MP and go to media - MPs are great - I've used them when I've had problems with various authorities (they want your vote don't forget!)

IMO you will stand a better chance of sorting this asap with professional help and I'm pretty sure you can get 30 mins (it used to be) free advice on most legal subjects with a solicitor (certainly when I worked as a legal secretary this was the case - AFAIK things haven't changed). If you try and tackle it on your own the "wheels" (scuse the pun!) are sure to grind more slowly.

Edit - I'm such a slow and careful typist that I was beaten to it by the above! lol
