On a bit of a tangent, here's who the law would have us leave our safety to in Canada:
http://network.nationalpost.com/np/b...isconduct.aspx Conspicuously absent are the 4 RCMP officers who tazered a confused Polish immigrant to death in the Vancouver airport (and then lied about the circumstances before it was all revealed on tape: http://www.youtube.com/watch?v=IPe_hf7aBXM). One of those 4 RCMP members then killed a young motorcyclist while driving impaired, didn't stop to render assistance, and then claims he went home and downed several shots of vodka (so he could avoid prosecution - which has apparently worked). They're all still on the force. ![]()

IMO, the bloke didn't do anything wrong.

A couple of weeks after having my car stereo stollen 3 lads tried to break in. Once the alarm went off my dad and I were up and out, down the stairs straight and out the front door to cut them off we chased 1 for about half mile but they were getting away something to do with not sleeping in our clothes or trainers lol.
Anyway once back home we looked at the damage/called the police (all after putting some pants and shoes on of course lol). I asked my dad what would we have done, had we caught the ****, and he wasnt sure. So he asked the police when they arrived what could we have done in that situation and they said if we'd have caught him and brought him back to our house, then knocked him about a bit on our property the police would have used a bit of common sense and left out the bit about us going and catching him. I think thats the problem for these 2 guys, they didnt catch him at the end of the drive they caught him and beat him to a pulp in someone elses garden. Regardless of the mitigating circumstances the police cant be seen to let that kind of thing go. It discusts me tbh that they've got such a harsh term for it though. If they'd have caught people breaking in, given chase and left one for dead then I could understand a 18month term. However having had your family tied up etc, I think you've got a right to have a bit of voilent theraphy against your attacker should you break free and catch one of the ****s. Another EPIC FAIL by the CPS for Jo Public IMO |

Jail is a place to keep dangerous people away from the public. This man is not dangerous. The dangerous criminal is still at large in this incident.

The law of the land says you can use 'reasonable force' to defend yourself, but in this case beating the burglar to a pulp would not count as reasonable force, unless the burglar attaked his victims with the same force. Which doesn't seem the case

whats the laws position on if you were to say, "I feared for my life when i was tied up, once free I had no other thoughts then to save my family and myself. I stopped when I felt my family and I were safe as they'd definetly not be returning"

If the burglar had not attacked you, then you'd be on a sticky wicket.
If he'd tried to kill you, then you'd be within your rights to use a similar force to protect yourself and your family
