Well I've already given my sympathy, but here's some advice.
A couple of years ago my wife pulled out on a biker, she hadn't looked carefully enough & he was probably going a bit too fast. He jammed on his brakes and locked the front wheel of his nice shiney new V-strom650. He hit the deck, but there was no contact, old bill turned up at the scene, but wife wasn't charged or anything. OB came round and took a statement of the facts. Wife did not admit liability at the scene and it was a 50/50 scenario. His insurance claimed for the damage to the bike & his personal injuries (none at the time!), our insurance sent a man round to get the facts, but eventually settled in his favour without contesting. So there maybe some scope for claiming off her, but maybe cheaper to have the paint and other broken bits replaced by you, rather than your insurance, even if you win.

More than anything I just don't want the hassle or the unfairly inflated premiums even if I would win and she was 100% liable, as soon as I make the claim I am in for a shafting regardless of how it pans out

I often stand up on the pegs and eyeball the driver in those situations, its so easy to get caught out like that, the drivers just wont be looking for you.
I wouldn't claim if i was in your postion, i hope it doesn't cost you too much. |
