Yeah thats the legal stand point, but it doesn't say anything like that in the insurance. unless in that situation your alloud ot ride your bike without mot and insurance.
But you are allowed to ride it to be fixed so it can pass its MOT.

Well f*ck me! What a result!

Would you f*cking believe this...

Revised my letter and sent it as a pdf at 10:30 this morning. At 11:15 the guy phones me up saying that they have reviewed the case and that they are willing to send me a cheque TODAY in settlement for £550. (£700 less the excess).

I sense that I might have the upper hand here... stress what good nick the bike was in and that an enthusiast would have paid well over a grand for it... I'm put on hold... listening to the Kaiser Chiefs - Modern World for a couple of minutes...

"We can revise the offer to £750, (£900 less excess), but no more as we're not now making a deduction for the fact that the vehicle had no MOT".

I'll take it. Not as much as the bike was worth, but I didn't pay what it was worth either so I'm only a bit out of pocket now, rather than the full stonking lot!

Thanks a MILLION to those who helped, what a fantastic result... if i ever see you at a meet, the beer, (ahem... coffee...) is on me. :P :P


Revised letter below if you're interested, basically a mix of mine and Northwind's;

Dear Mr Pearce,

I refer to past correspondence relating to the above matter and our telephone conversation of 18th May.

I am disappointed to hear that you do not intend to honour my policy No: JH*******************, (copy attached), following the theft of the insured vehicle.

At the point of purchase I specified to the Devitt sales agent that the vehicle did not have an MOT certificate of roadworthiness, and that it would be parked in an on-street motorcycle bay. I also clearly stated that the reason that I was re-insuring the vehicle was to have it MOT’d and begin using the vehicle for commuting again.

Devitt requested copies of my Driving Licence, CBT Certificate and Road Tax Licence at the time that I purchased the policy but never requested a copy MOT certificate, neither was a deadline set in which to have the vehicle MOT’d. Please refer to Devitt for confirmation and copy correspondence if required.

You have been provided with the receipt for the full servicing of the vehicle which covered the engine, oil, air filter, brakes and lights on the vehicle. The receipt also included the replacement of the rear wheel hub. In effect the vehicle was brought to a satisfactory and well maintained roadworthy condition at the time of that service. For clarification however, I confirm that I was not using the vehicle on the road and had not been since June 2005

I have also provided a copy of the current tax disc. The vehicle was kept in a designated motorcycle bay and covered with a waterproof motorcycle cover during the period that I was not using it. I started and ran the engine on a weekly basis to keep the vehicle in good condition. I state again, the vehicle was in very good condition, with no significant scratches on the paintwork, no rust on the chrome and mechanically sound.

In June 2005 I had taken the vehicle to R Agius, a specialist Vespa retailer on Edgware Road in London, for a verbal opinion of value as I was considering selling it and was advised of asking in the region of £1,500. I do not have any written valuation to this effect.


Given your verbal response of 18th May 2006 I have been advised that the policy which you offered me was mis-sold, as it did not cover my vehicle under the circumstances clearly defined to your sales agent. As it is now your contention that these circumstances are specifically excluded from the policy, it is clear that your sales agent failed to advise me appropriately of the limitations and conditions of my cover as is required by law.

While I am sure that this was a genuine oversight on behalf of your sales agent, the fact remains that the policy at no point protected my vehicle as agreed. Had I been informed appropriately, I would not have accepted the policy under the terms described.

Therefore, I wish to make a formal complaint on the basis of this mis-selling. Please forward details of your company’s formal complaints procedure by return.

While I believe that I have a clear claim to request full refund of the premium paid, due to the failure of the policy to satisfy the purpose for which it was sold, this would not address the loss of the vehicle. I acted in good faith on your sales agent's advice that the vehicle was covered under the conditions described. Had I been advised that this would not be the case, I would have made alternative arrangements to insure the vehicle, or taken steps to avoid the issue with the MOT certificate of roadworthiness. Therefore, a simple refund will not reflect the true cost to me of your advisor's error.

I hope that we can reach a mutually satisfactory conclusion to this matter. However, in the event that you choose not to honour your obligations under the procedures laid out by the FSA, I have been advised that I will have a very strong case to present to the Financial Services Ombudsman.

I will also be making a formal complaint to Devitt Insurance Services Limited regarding this matter.
