You seriously need to talk to a proper solicitor about this. Even more when they say the dyno they were going to use "broke" and have arranged for testing on another. I would doubt that there are more than a dozen dynos in the country adequate to perform the test. And by Dyno I also include the operator who must be accredited with the qualification and experience to adequately convince a court that the tests he performed were sufficient to demonstrate your bike exceeded the proscribed limits.
As has been stated before, there are strict procedures for evidential testing. Simply dumping it on the dyno at the local bike shop would be laughed out of court should it ever get there.

Ask the inspector again? I'd be having a sense of humour failure about six pages ago. From what you've typed I can't see any reason for all this hassle. Supply the part number for the CDI if you think it'll help. Wouldn't want a bike of mine bouncing around the county in the back of a van for no reason.

Well there is a very easy way to tell if it was a full power or 33bhp ECU, when you rev the throttle and it gets above 6,000 rpm it increases in revs at a slightly slower rate than it did getting to 6,000 revs. The full ECU increases at the same fast rate throughout.
Admittedly I don't have a Sv now, but I remember this clearly when mine was restricted. at 6,000 revs it felt like it lost a tiny bit of power. |

Absolutely bizarre, the whole episode.
As said previously, get WD or another specialist solicitor on the job. If they come back wanting to do you for "Driving other than" on the basis of a dubious dyno test, take it all the way to court, they'd have to be absolutely precise in all the details of testing to make it stand up and I'd be very surprised if all the "i's" were dotted and "t's" crossed. The one thing that's been niggling me about this is the comment from the boys in blue on here that it is effectively up to you to prove you're innocent. Them taking the bike from you effectively deprives you of that opportunity. Also if they had reason to believe it wasn't restricted then just charge you on the basis of that belief and whatever evidence they had, and leave it up to you to prove you're innocent in court. What they are doing is setting out with the specific purpose of proving you guilty. You really do need that legal representation. ...and get onto the tyre manufacturer for a written view. Good luck.

cant belive you seem so calm about this all, well from the posts you have put. I would have been at the police station door waiting at 9:00 monday morning with solicitor and demanding some answers. and I will still take them to court for all the hassel
