Baph,It sounds by your description that it would more than likely be a clearway which would exonerate Mrs LC to a good degree but if it was me I would be down there early on a sunny morning and get photographs of any relevant signs and the road layout to forward to my insurance company. A few good photos can be clearer to the insurance than a thousand words.
Sorry again LC but I couldn't understand why you were so puzzled at the beginning,but following that description I now see how you could have doubts.
GET PHOTOGRAPHS OF THE JUNCTION AND SIGNS
and make it simple for the insurance

Thanks Dickey, didnt mean to be a bit "off" with you, but I was having a bit of a bad day! Wasnt keen on the driving lesson as Im a grade six instructor (which is the highest grade). I realise now you were just trying to be helpful.

Actually I did exactly what you suggested yesterday morning. Took pics of the scene, and the relevant road signs.

The other drivers insurance company have already been in touch with me to arrange a replacement tuition car which is being delivered on Monday, so it looks like the insurers have already had discussions about who was to blame.

Thanks Lissa. Shes a little better today. Kept bursting into tears yesterday at regular intervals.

Women eh?

I wanted to take some pics of the car when i saw it yesterday at the recovery yard to post on here, but they wouldnt let me. They said its not my property any more!

Does anyone know what happens to your private plate if your car is written off? are you allowed to keep it?

Yes regarding Private plate. Get in touch with your insurance and inform them that the vehicle has a cherished numberplate and should the vehicle be a complete write- off you value the plate at "x" but would like to transfer it to the replacement vehicle
Go to the DVLA Office and put it on retention ready to transfer and the vehicle still belongs to you till the insurance has either replaced it or paid restitution. The vehicle is still your property,even while in their possession,till full reimbursement has been made

What an absolute jobsworth some people can be Whether it is or isn't your property anymore (I doubt very much that your insurance company has paid you for it & you've sent the V5 to them) What harm could it be to take a pic of something regardless who owns it.

I despair sometimes

Fair enough if you were going armed to strip the alloys, stereo etc.
