I'd say 50/50 is a bit harsh, but even if it were 90/10 the jag drivers fault, it still takes 100% to make a collision.

If you want to pass, it's YOUR responsibility to make it clean - ergo Jag driver is entirely wrong, however poor the road positioning of the scoot boy. Short of someone actually changing lanes into your path while you do it - the responsibility lies with you.
