Don't mess around. Keep it official. You may end up getting done over otherwise. People change their mind about things and try to wriggle out the further from the incident it gets, especially once the amount of cost is worked out.

She has essentially admitted liability by texting you and saying she wants to avoid her insurance. They won't be pleased with her trying to do that. If she is trying to avoid them then she won't have told them. They also won't be happy with that and it all counts in your favour. The 50/50 thing is a load of rubbish. Unfortunately for her if she's behind you then she's in the wrong.

I'd do it through insurance and keep it very logical. Avoid personal dealings or conversing with her. She may be decent about it, but the amount of times I've had people change tack days after incidents and I've been done over I wouldn't do anything outside insurance and official channels now.

I agree with that. The other person's fault and their insurance should pay for the damage to your car. I got shunted from behind on my bike and the other driver immediately admitted liability and their insurance company soon contacted me to settle the matter, but I had already notified my insurance company to collect the bike so they dealt with it. Everything was fixed and I didn't have to pay anything.
ps I did think anyway if the other insurance company had dealt with the repairs they might try and skimp on the work !

I've notified insurance, woke up in the night with realll bad neck pain and it's getting worse. To be honest if I was convinced it cosmetic only and could see into the future that might neck will be fine in a month or so I'd put my concerns about what if she'd hit a more vulnerable road user to one side and skip the insurance. But you're all right, tis for the best that I engage with the forces of evil, alas. I also spoke to a girl at work after I notified insurance who's been off a lot recently - turns out it was coincidentally ongoing pain from a whiplash injury 6-12 months ago.

I'm a bit annoyed that I probably could have moved if I wasn't so complacent, I check the mirror when coming to a stop in these sorts of scenarios and initially thought 'she's not looking' then thought 'ah, she'll probably make it' and looked back at the road... looked back rear again and at that point realised she was not making it

How do we know if our premium is increased because of a 'no fault' claim ?

The insurer told me it is when I notified them "you fall into that category now and we can't erase it from the systems"

All the more reason to make a claim for your injuries too. I'm no fan of the insurance system (see my recent posts about van and bike insurance.. I'd put it somewhere on the list of legalised extortion systems) but it is a system and you need to use it now. When I got driven through by an elderly gentleman when cycling to school to get my kids my injury values were calculated by a list that insurance companies go by. Not being able to breath without pain for two months was worth £x.xx, loss of sleep due to agony was worth £x.xx etc. It was a surprisingly pitiful amount in the end. Your whiplash will be calculated and you need to claim it to cover your future premium increase I'm afraid. There's no other way you're getting that covered.

It's a crap system by we're legally obliged to buy into it and I'd make sure your insurance company gets to work on it now. Think of all the years you've paid them for nothing.

It will take time too so don't get frustrated by it. Keep in touch with them if it goes quiet but don't let it wind you up. It ruined a year of my life with stress leading to head problems for me. I had some PTSD mixed in with mine too though.

you only loose no claims if you claim on your fully comp insurance to have your vehicle fixed while the other parties insurance pays out. once the other party is deemed at fault then your no claims is re-instated. insurance companies cant increase your premium due to a no fault claim and if they mention that they will then also claim the excess from the other party at the time of payout.

do you have protected no claims? then all is well.

thats a good old shunt up the back in that video and i would be surprised if there was no damage.
