I worked for a council handling the paperwork for Public Liability claims for pothole damage to vehicles. The official depth of a pothole that affect a councils liability is, from memory, 70mm. Any damage to a vehicle from a pothole exceeding that depth can be the subject of a Public Liability claim on the council. The council is legally obliged to keep records of all pothole notifications as evidence in the event of a claim. So the council responsible should make sure potholes like this are repaired asap but not all do. A few years ago, Stockport Council paid out over £5 million in claims in a year because they thought it was cheaper to pay out the claims than to repair the roads.

If you get no joy, I'ts worth getting a solicitor involved in your claim.Most will do a no win/ No fee basis.

They are claiming it was inspected and was fine 2 months before it happened and because they have no record of a complaint they are not responsible.

It's extra annoying for me because I can't buy the same alloy any more so would have to buy 4 new wheels and potentially tyres too

Even if they accepted the claim, it's highly unlikely that they would pay for more than the one damaged wheel anyway. The council I worked for wouldn't as the liability is for the damaged one only.

I've seen pics of wheels that Richie Foss, near Loch Ness, has repaired that I wouldn't have thought possible.
He doesn't paint them though.

I got another big fat 'f**k off' letter today from the council's insurers in response to my email. There is no justice in this world.

I also went to an alloy repair place but they said because it is cracked on the spoke it is too risky. I'm thinking about getting some steelies and putting winter tyres on with some ebay hub caps. Annoying thing is I would like to get a new car, but I can't trade this in with 3 alloys and a space saver
