Completely agree. Sticking it in the small print means that well-intentioned drivers could be driving uninsured without knowing it. Of course you'll only ever find out if and when things go horribly wrong - which is what you pay your insurance for. It should be illegal imho. Minimum levels of cover should be mandated by law and should cover this.

This is what they said to me....
Dear Mr. xxxxxx Policy number: EB205xxxxxxxxxx Thank you for contacting me regarding your policy. I can advise that if your MOT has expired on one of your bikes then we will not provide cover for that bike to be taken to an MOT Station as the bike will be classed as un-roadworthy. If you need to take one of your bikes to have it's MOT you will need to get transport to take your bike there as you will not be covered to ride your bike to the Test Station. They can put whatever stipulation they want on as a condition of their insurance. The problem is I suspect the vast majority of their customers are not aware of that particular condition. I guess it's not a problem if you only have one or two bikes and use them both all the time because generally you'll keep the MOT's up to date. I'm fortunate enough to have a few more some of which I only drag out from time to time so quite often I'll need to test a bike that hasn't had an MOT for months, or even years.....
