Drug related law question
Thinking back to the useless days in school of "personal, social, health education" we watched a video on drugs, and one of the stories was of a girl who nearly died from a heroin overdose (she went to a hospital and was crital, but recovered).
I asked the question 'would she be arrested for use and posession after she recovered because it was clear what she overdosed from?'. The teacher never knew the answer and i just remembered it today and was wondering. Does anyone know? |

i guess technically she could, i doubt she'd be charged. more than likely a compulsory rehab course would be the order of the day

she cant be done for posession as she doesnt have any on her (except for the stuff in the blood).

Can you be arrested for being under the influence of drugs? E.g walking past a policeman obiously high on something and stinking of it?(whilst not driving)
And before anyone asks, i am not asking for my own benefit, im just interested. |

and she is not in possession....no charge stinking of it? than ur only onabout weed id guess.....no u woldnt be arrested....possibly searched.....even then just shoo you on your way |

I think thats quite bad. I'm sure they will invent a way to test it though, the same way they do for alcohol. The process for testing if a driver is under the influence of drugs is so much longer than a breath test.
