Default MOT & Exhaust Question

One really for an MOT tester or someone in the know...

My brother has just had a new set of pipes custom made and fitted.

Upon starting up his bike I said "well they an't legal then...."
*they were very loud*

There are no markings on the exhaust to say NOT FOR ROAD USE, or ROAD LEGAL or E4 or BSAU etc....

To which he said that the MOT tester is not allowed to start the motorbike so would not hear the noise (so would not be able to fail the exhaust noise as significantly louder than originals), also as the exhaust has no markings this indicates that they are road legal.

Looking through the MOT motorbike test requirements the exhaust / fuel system needs to be checked for leaks, how can this be done if the bike is not running?

So long question, and a bit of background, so who has the answer?

Can the MOT tester start the bike? would his bike pass or fail with these on if the bike was wheeled into the MOT station....

not an issue now as the bikes only a year old.... BUT just interested.

think MOT testing stuff like this is down to the specific MOT tester - I took mine to on place where they gave an advisory for excessively loud exhaust or something, and then took my next bike to old dickie who operates out of an old shed and has his own motorbikes museum, when he fired it up he just grinned and shouted "that sounds well don't it?!" despite that specific can having "not for road use" on the end of it..

It's the MOT testers discretion as to the loudness of cans and if he should or should not pass its MOT. Most will allow but if too loud might fail it. They will have to start the bike for a brake test as they normally use a rolling road.

pretty much as I thought.

My exhaust will be in the same situation next year, so need to find someone like 'old dickie' who will just grin at mine!

Think most people are usually happy to recommend a suitable 'aftermarket-can-friendly' tester on here if you ask in the Soho Massive section and yeah I imagine big national companies might be a lot more stringent over testing than local independents, especially if they're bikers themselves.

Dont know what book your mates got .But the oficial one is on line with how its checked

Information Method of Inspection Reason for Rejection 1. Examine the condition of the exhaust system including the silencer(s) and mountings for security, deterioration and completeness. 1. a. Any part of the exhaust system missing or excessively deteriorated b. a leak in the exhaust system which causes excessive noise to be emitted c. an exhaust system mounting missing or one which is in such a condition that it does not fully support the exhaust system. 2. With the engine running assess the effectiveness of the silencer(s) in reducing as far as is reasonable the noise emitted. 3. Check the silencer(s) on all machines for any unacceptable markings. 2. A silencer that is in such a condition or is of such a type that the noise emitted is clearly in excess of that which would be produced by a similar machine fitted with a standard silencer in average condition. 3. A silencer marked ‘NOT FOR ROAD USE’, ‘TRACK USE ONLY’ or similar words"

great info guys! his source of information was the garage who fitted the pipes for him - hence me being dubious.
