Default Victims Charter

Has anyone heard of this before?

Reason I'm asking is at the start of the month I got taken out by someone turning righ into my path. Today I get a letter from the Met asking me to fill in the details of the accident. Sent me a witness form so questions like How far from the incident/colision where you? I found rather amusing. But the last page is a form stating that tif there is sufficient evidence there are four ways they could deal with the case and to tick the box I feel most appropriate as my views will be considered.

The options are

1. Summoned to court etc
2. Driver improvement course
3. Warned as to driving conduct
4. no further action

Most likely go with the improvement course, if nothing else it at least inconviences him. I'm bit grumpy 6 weeks in a cast, cancelled track day, cancelled flying leasons and it itches like hell at the moment.

I had to fill in one of those too and had a chuckle. 'How far away from the incident were you?'

Anyway, I chose the first option and he is due in court in September for driving without due care and attention and no insurance. Hopefully will have the book thrown at him.

How long did it all take and did it affect the insurance paying out?

It was the wifes bike and she's starting to look at my Triumph. I need to replace hers soon

it all depends on what the bloke is like, as to what punishment you would rather give him, dont you think.

some people are too far gone for a driver improvement course.

I had one of these too. I chose option 1.

Bus driver had literally just left the station to start his shift. Jumped red lights and I rode straight into the side of the bus. I wouldn't have been so ready to chose this option had he not first say it was my fault, and the carry on to say that I was a liar and trying to blame him for my mistake.

He was let off completely of any charges at all. How's that for justice.

Took me 2 years to get my claim settled too.

So I wouldn't be too bothered what option you choose. They wont pay any attention to it.

You get given the same options if you fill in a witness form too. I don't really understand the point though.

If a crime has been commited it should be up to the police to persue it, and that includes approaching the victim/witnesses to gather evidence. It seems with this form that they want to put decisions to the vote, turning control of the justice system over to the mob. I guess those who shout loudest will get their way

Always choose number one.

Get them sent to court. Saying that if they go not quilty then u may be called as a witness.
