Default Accepting split insurance offers

Hi chaps,

Got the skinny from my legal dept about my claim for last year. Basically, they reckon they can get 100% at court, but there is a chance that they may not. The other ins co have an offer on the table of 80:20 in my favour. Must say that I am quite tempted to take it and move on. However, what I don't know is how much this will affect my ins quotes going forward.

Does anyone have any exerience with this? Presumably I'll be stating that in my insurance applications for the next 5 years and I'll start my no claims again. I've already had to renew the SV so I'll be back on 1yr ncb in August, but how much extra would the claim add to my premiums?

To my knowledge, if you accept any fault, you loose no claims. It could be a case of "welllllllll, I'll accept partial fault, but I don't want my part to come from my insurance, I'll settle that privately" and therefore no effect on NCB.

If you weren't at fault (possibility of a 100%), and you have transport, does it cost you anything to fight it? If not, it's time for some fisty cuffs my man!

The other ins co are just trying to get out of paying, why the hell should they? Yes, you might loose & get a 80/20 in favour, but you might get a 100/0 in favour.

If it were me, I'd be fighting.

Years ago, I took a bloke to court over an insurance claim.

He moved over and parked on the right hand side of the road as I was overtaking him. My claim was about £4,000 for bike and boots and helmets(2up). Norwich Union, my company, provided no legal assistance.

Anyway got 95% in my favour, with 5% against cos I was overtaking. Norwich Union viewed this as a no fault claim, it was originally going knock for knock, so they were happy, and I kept my no claims bonus.

Not sure what the policy would be on 20% fault. Why not ask your insurance company.

From what I understand, I could end up with something worse than 80:20 if I went to court.

If they're offering 80:20 they can't be that confident. I'd fight it.

BTW, you won't lose all your NCB, mine has been reduced from 5yrs to 2yrs while my claim is pending.

Yup, this is entirely possible - though if the other side are currently offering 80:20 I'd guess that the worst case court outcome would be something more like 50:50 rather than you taking full blame.

Are your legal people able to advise what they think the worst case scenario would be? If not, you could always seek a second opinion from a specialist m/c claims company, then you can make a more informed decision.

by offering 80:20 they're practically admitting liability for it. All the insurance companies wuss out of taking it to court. I'd go for it if i was you, you'll win!

do most claims end up going to court?? i had a crash 7 months ago, still pending, so im not sure what is going on there. but i did have 4 yers no claims now its down to 2, and it was all my fault. went into the back of someone. you cant argue your way out of that really. but what reasons do they need to take it to court?? niether party was injured, wrote my bike off over winter, and the car had some damage. why would you need to take it to court? sorry for my ignorance but its my first insurance claim.
