Default Any employment lawyers out there??

looking for some legal advice.

I overpaid tax in my previous employment, so I get my P60 through the door the other day. In it my current job bit it states that they have refunded the tax paid. Yet I have recieved none of it. It has taken me this long to get them to send me a P60, and then when I eventually got it and went to the tax office they tell me to take it up with my employer for this reason. But getting anything done with them seems inpossible. what do I do? I have all pay slips (well bits of paper with my wage written on), and can get a hold of bank statements

help is greatly appriciated

not yet, I'm waiting to see if anything happens tomorow, as my wages normally arrive on a friday, but after that, I'll be out of ideas

tax refunds would come to you personally not a previous employer. Doesn't make any sense.

I haven't applied for my tax refund, I went to the tax office, and they said that I couldn't as the p60 says the tax was paid back through my employer

Surely your new employer wouldn't actually know about the tax rebate, you'd get the money back through having a different Tax code?

my new employer see's what tax I've been paid and not on my p45 that I handed them, and I haven't paid tax with my new employer due to me earning still less thn the £5100 odd cut off.

on my p60 it says

Pay and income details:...Pay........Tax deducted
previous empolyment:.....4967.71......514.54
in this employemeny:......72.34.........514.54 (then a 'R' in the refund box)
total for year:................5040.05........0

Get onto the tax office and say you haven't personally received the refund.
See what they say.

If a previous employer has received it & not passed it on to you I reckon that would be quite serious offence.

Just a sorry for a dampener here
but if your PAYE tax is deducted at source and if you have earned that much since april tax would have been deducted at the normal rate and if your new comapny is not taking tax off you you are going to owe the taxman money not the other way around

The new company was not taking tax off me as I was not going to go much over the threshold of paying tax before April, which for 2006-2007 was £5,035. If i had continued in my previous employment I would have gone way over this in which case I would have paid the correct tax, but as I have not gone much over the tax free amount. I am due all the tax I have paid back (minus £1 for 20% of the £5 over). It was the same last year, (only far easier to claim back the tax I was owed was actually printed on my p60 as owed to me, so I just sent it away).

The tax office agreed that the money was owed to me, and say it has been refunded to my employer who should have sent it back to me.

The tax office recommended I speak to a lawyer if the company I work for hasn't paid up the £514.54, as it is definitely owed to me. which was why I was requesting if there was one on here that could help.

I am going to speak to the person that deals with tax and income for the company on Monday, if that doesn't help I'll get onto the citizens advice.
