As Pete says, even if you get the phone records, unless you have corroborating witness statements to the fact, it would be very hard to prove that the driver was actually the one using the phone illegally before/during the RTA

unless the law decides that that isnt actually a valid argument and you are guilty regardless because of what the mobil phone report says.
which i hope isnt the case because but with the way the world is going, it wouldnt surprise me too much.

now a days you have to regester pay as you go phones in much the same way as contract phones. probably in an attempted to monitor calls to prevent crime or some such.

if they are willing to jail someone without trial (yes they have in the UK) then why wouldnt they be willing to force through a proecution to add a bit more revenue!

Just want to say im TOTALLY against using phones whilst driving.

But its interesting to know in case your ever in an accident and you have seen the other person blagging away on the blower.
