Regardless of whether she was on or off the footpath, the offence he commited was a lot more serious than dangerous cycling.

He, through a refusal to stop or take early avoiding action, cause someone to die.

Thats the bottom line.

His shouted warning implies, in my view, a willingness to actually collide with the group.

He should be sent down and be treated in a way that will have him not wanting to sit on a cycle seat for a LONG time.

but yeah sad to say sounds like it should have been a lot harsher a sentence

edit again, I am very reluctant to outright call for a custodial sentence as it's very much a case of 'there but for the grace of God...' for all us bikers dealing with lemming pedestrians.
And if they're not complying with a proper crossing, they get little sympathy from me. But having enough time to shout a coherent threat such as he did would suggest to me that he could have avoided her and unfortunately we all have to live with the actual consequences of our actions rather than what we thought would happen.

Considering who ever wrote the article can't make their mind up about what it was that even hit the girl, I'd imagine there is more to this story that we're privy too. Suggest against making sweeping statements based on rubbish evidence.

Would agree with flamin' here. There appears to be a lot more to this case and the press have done their usual quick publish scant details with little substance. The fact that they editted the information as it was written as though the man was driving and not riding a bike should indicate to us all how reliable their information is.

Our justice system isnt perfect but I would imagine there is a bloody good reason why the judge only went for a fine.

haha, i've managed to confuse the org...

i edited the story to make it appear to portray a car driver causing the accident, in order to arouse a feeling that the fine didn't fit with the severity of the offence... i thought the one rulle comment was enough to convey my intentions:smt064

Known, undisputed facts

1) He yelled a warning indicating a reluctance to slow/stop

2) He hit the girl

3) She died

Thats what I based my "Sweeping" statement on.

Not so sweeping I think

If she was in the road and wouldn't move even though she was warned, what would the outcome have been if the cyclist had collided with her and died of injuries sustained in the collision.
Yes there are lots of "buts" and "ifs" and I suspect that the issue will be talked about for a while yet.
I used to do a lot of commuting on a push bike and regularly reached speeds of 20-30mph. Stopping and/or changing direction at that speed was not going to be a smooth manouvre so if she was in the road and he gave warning then yes it is an unfortunate accident but, should he go down for it ????
Out of curiosity, how many of us have beeped our horn at pedestrians crossing the road when they shouldn't and not altered our speed or direction??
When I go to Frith I go up Shaftsbury Avenue and the amount of people that I "nearly" hit can sometimes be quite a few.
