How can the police take his licence from him without going to court? Is this some new police power? Mr. Cynical here says that it's just a way of the police avoiding doing the paperwork and sweeping it all under the carpet. Go and talk to a lawyer, quickly.

It would go to court but not infront of a jury etc... it wouldn't be a criminal case or something like that, I was off my head on painkillers when they where going on about it. But I'd rather they take his licence off him then risk him only getting points.

Mate, I suggest that you PM either fraser01 or gforceuk - they are both serving plod (no disrespect there chaps :lol: ) and I think they're both traffic chaps. Certainly, fraser01 is.

As a layman with an unhealth interest in the law, I'm not aware that the police can issue summary justice to that extent - their limit is, so far as I'm aware, the issuing of fixed penalty notices and other similar things.

The power to remove an individual's licence is limited to the Courts - there would be an outcry from the general public if the police had been given this power. Ask Getyourkneedown - he's been the victim of an overzealous policeman recently. :lol:

At the very least, the "tool" who turned across you would be prosecuted for "Driving Without Due Care and Attention" and possibly even "Dangerous Driving". The police cannot issue summary justice in such cases, much as you might like them to.

Traffic police have just been out to take a proper statement from me and didn't have a clue about what I had been told by the other officers. But he's being taken to court on due care and attention and his arguement is that 'He didn't see me' I couldn't help laughing. :lol:

Seek proper legal advice and sue the b*st*rd for all he's worth!

His insurance company will take the hit, but don't settle for anything less than you deserve.

Well seeing as 98% of the population seem to be anti bike maybe that's a good defence. It could be said (by some) that by riding a motorcycle we accept the fact that ********s in cars are going to hit us.... And therefore it is our responsibility to make sure they don't.

With this government you can just never tell...

The company who owns the bike I was riding at the time as part of thier public liability insurance have set about some £250 an hour solicitors onto him for me and they said it'll all be sorted inside 8 hours of court time, they also charge £16 per letter sent and I've had 3 consisting of 1 sentence.

The evidence against him is far too strong unless it's a bleeding heart judge in which case if he gets off lightly I'll get Mr Smashy and make a mess of his leg like he did to mine :lol: , though in the end aslong as the compo payout is enough to buy me a mint RZV500 or RG500 I'm happy.

My opinion on car drivers and anti bike people is they need to be forced to take a free bike test before they are allowed anywhere near a car and even then they aren't allowed to make any mistakes on either as one of those minor mistakes could take someones life, 15 minor mistakes allowed is a joke.
