I got all the guys details and a witness too, spoke to the insurers and they are sorting everything out as we speak. Got Bikers Legal Defence on the case too and my case is being passed on to a LAw co. To my mind i dont think i was at fault as the guy was stationary and didnt indicate before changing lanes but no doubt they will contest all this and it will drag out for ages like my other one thats on going.

Something along the lines of "Sorry mate, I didn't see you?" Sounds like it should be pretty clear cut at least, insurance wise... And you're OK, which is the main thing.

I see this a lot near me.
We have a dual carriageway with a "2+" lane for dual occupancy vehicles and bikes. Its a pretty dangerous design because the outside single occupancy lane gets queued back miles whilst the inside 2+ lane is empty. When people in the singletons lane get near the next roundabout and want to turn left they find themselves having to move from a stationary lane into the 2+ lanes flow of 50mph traffic - not easy if you have a lorry stopped behind you blocking your mirrors... Anyway you get some pretty wild lane changes. I always try to keep my speed down so that speed differential isn't so great. I wonder if I was going 50 whether that would be classed as contributing to the accident? If it happens in my car then no but if it happens on my bike then I bet it is! I would under estimate your speed in this case mate! |
