They haven't said anything about the Seat Cupra Cup video though, on the same page, taken the same day....

You are broadcasting it. There are already rulings in this country that state this. Can't be arsed to look for sources right now, though.
Do they have rights to the Seat Cupra races?

I really think they do just mistook it for their material, but either way, complaining won't work; the bureaucracy will make sure of that.

You ARE broadcasting it tho.

Putting something on the Internet has been proven to be the same as publishing it - some people who had a porn site hosted in the US (where the content was legal) were done in this country because they uploaded from the UK which was deemed to be published here - so they were done under UK law.

Publishing is what you do to books/pictures, broadcasting is what you do with video/music.

Yep it sucks big time, but thats how the law sees it.

Yes you are not broadcasting their footage, but you may be breaking their exclusive rights.

Might it not be wise to discuss this on the forum ? If they found your video's on you tube they might find you complaining about it on here. Which might or might not land you in further hot water.

This happened with the IOM TT if I remember correctly.

The broadcaster had an exclusive deal to broadcast footage of the event.

So although other people had filmed the event with their own cameras, they didn't have permission from the organiser to broadcast this footage as the organiser had already signed an exclusive deal.

Things were a bit messy in that case as the event took place in public so a resident of the IOM could theoretically have every right to film what happens outside their front door but I don't know what happened in the end.

In this case you have entered a circuit which is private property and the owners of that property have deals with the event organisers who have a deal with the broadcaster for exclusive broadcasting rights.

Thats how I understand it. Gay but true. I say gay because that is what ITV are if they complain about harmless camcorder footage. Only solution is to not watch their broadcasts so they lose advertising revenue but somehow I can't see everyone doing that.

What makes me laugh is that F1 looks and sounds 1,000,000 times more exciting on a £300 camcorder compared to the TV broadcasts!

Can't complain for having an opinion and a moan, freedom of speech and all that.

I've just spoken to someone at ITV and will be sending them an email staing the information. Will let you know what happens.

even if it does turn out to be illegal, i still agree with you that it is petty and gay. Who would choose to watch your 30 second clip over the ITV coverage? Surely that is what they are worried about afterall...

Surley having a short clip online would only entice people who haven't seen it before to tune in thus increasing possible viewings.

Im not making any money from it either.

Copyright laws in the country are far far reaching. Whats been said above is pretty much on the nose. You will find that ITV or the company filming for ITV have the sole rights, boradcast and suchlike to that race. Yes it is sad that they are clamping down, but they are exercising thier rights to activly enfore thier copyright, and that includes you.

If you go placing the videos on other sites, then they will find it, as they probably have an entire department that look for this stuff and you can get 6 months inside for continual infringements, and one hell of a hefty fine. The compnay i work for a couple year ago got find £50k for one of our sites copying 2 A4 pages once.

My advice is, if they say no, then just toatly drop it, unless you want a very big law suit and have bottomless pockets.
