I have to admit it but I am a cage driver as well. I passed my car test in 1984 and my bike test in 2006. Out in the car one day a few years ago I was waiting to turn right at a T junction. The road was clear to the left, to the right a car was approaching with its left indicator flashing. My wife said to me "what I you waiting for, that car is going to turn left". I said I would rather wait and find out for sure. Sure enough the car went straight on, they had just left their indicator on. Had I pulled out when my wife said I would have ended up in hospital.

It just goes to show you can't assume anything.

A friend of mind was in this exact situation a few months back. However unlike you he did pull out.
Fortunately he didn't end up in hospital but his car was written off.

Most importantly, the claim went the way of the other driver!!

A little, i would have expected not a win but more 50/50 if anything, but then again, you do fail your driving test etc if you pass a junction with your indicator on etc. So they might have used that type of judgement on the issue.

Not really, they had right of way. Yes they should not have been indicating, but it is surely the responsibility of the vehicle pulling out of the junction to use all reasonable car to make sure their path is clear.

Not really, they had right of way. Yes they should not have been indicating, but it is surely the responsibility of the vehicle pulling out of the junction to use all reasonable car to make sure their path is clear.

Ah. My bad, marcs post was a little ambiguous regarding which of the two cars he was driving and I read it as though they were the driver of the car pulling out.
