Not sure wether to say Unlucky or Lucky.

Unlucky to get hit, Lucky to stay on!

Cant see this as a 50/50.

Highway code says:-

109: Areas of white diagonal stripes or chevrons painted on the road. These are to separate traffic lanes or to protect traffic turning right.
  • If the area is bordered by a broken white line, you should not enter the area unless it is necessary and you can see that it is safe to do so.
  • If the area is marked with diagonal stripes and bordered by solid white lines, you should not enter it except in an emergency.
  • If the area is marked with chevrons and bordered by solid white lines you MUST NOT enter it except in an emergency.
    Laws MT(E&W)R regs 5,9,10 & 16, MT(S)R regs 4,8,9 & 14, RTA sect 36 & TSRGD 10(1)
Assuming the condition 1 above applies, it was safe to enter the cheveron area when you did so. She was not there.
I was NOT safe to enter the area when she did so, you WERE there.

There may be a debate about whether it was necessary, but that applies equaly to both parties.

Search for Lynn W's filtering letter on here and use it. The more times bikers establish their right to filter the better, IMHO of course.

Please keep in mind that I do not have the faintest idea what i am talking about!

Good luck with the insurance bandits.

Bad luck Colby. I'm ashamed to admit I was an actual SMIDSY once :( . Before I had a bike I pulled out in front of a bike on a backstreet and nearly hit the guy, before I knew it I'd blurted out those exact words, I felt so stupid when I realised what I'd said. He said "should've f***ing looked then" or similar, if I recall :smt092

So SMIDSY should be followed by SHFLT? I find it best to carry a spare pair of glasses which I offer to the (BMW) driver at the appropriate point...
