With this i completely agree. They should be stricter on making sure vehicles are fit for the road.

Maybe if this was known to be an accident blackspot where black ice forms, the council could be held at fault for not gritting the roads properly if at all.

Could it be that even with 4 perfectly good tyres he would have had the same accident due to black ice? You can't see it and can lose control very quickly.

The accident occurred at a left hand curve, (for the driver), on a flat road out in the sticks with good visibility, the cycles, in a large group, were taking the same curve in the opposite direction, apparently the driver only discovered that there was a lack of grip when turning the wheel and the car went straight on, crossing the other lane and passing through the group of cycles. It's perfectly normal for a driver to not know about black ice until it's too late, as the car was on a straight section immediately prior it seems, to me anyway, entirely consistant with the, (reported), drivers account.
Whether the tyre's condition made a difference I feel is unlikely, without studs or chains nothing grips on ice. If the accident investigators think the tyres weren't a factor, I don't see any alternative assumptions to their findings as being reasonable.
What's most saddening is that nowadays the concept of a genuine accident has been eroded to the point of non-existence, there's no business in no-one being blameable.

The fact that car drivers seem to get away with everything and bikers dont.
My mates crash on Long Hill last year was the car drivers fault, we went to court to contend it (i was with him and saw what happened) my mate ended up with 6 points, £180 fine and it had to go through his insurance.

Mr BMW was on the wrong side of the road on a blind bend but it must have been our fault coz we ride bikes.
