Brilliant, thanks Stingo :thumbsup: As far as I can see it I was in the right, and I'm pretty sure the witnesses saw it that way too. I'll be going for 100% no fault as she is the one that turned in on me.......I'll have none of this "you shouldn't have been there" stuff.

The person that drafted the letter won their case 100%. I'm fairly certain that it has helped in other similar cases too.

I've got my version of the above letter too if required. You're probably best adapting the above to your case though (like I did.)

UPDATE:

Seems like an age ago now but the third party insurers have finally come back with an offer of 50/50 split liability.

Erm, no, try again.

The guy who is handling the legal claim at MCE seems to be on the ball and had rejected this offer on my behalf stating:

"this offer does not reflect the evidence provided as the witness statement they have received shows your vehicle within the right hand lane therefore they have changed lanes etc leading up to the accident without due care and attention."

He's going for 100% liability on their part and I've also forwarded him the link to the Davis Vs Shrogin case.

Cheers for all you help so far guys, let's hope the third-party insurers see sense!

They did the same with me it's been well over the year now and they've still not admitted liability. I've had *some* money - but not all of it yet.
