With regard to constructive dismissal (CD)...(not an expert) but I recall reading somewhere of cases where the boss has made life so uncomfortable/miserable for the employee that the employee has eventually packed the job in and then claimed damages for CD - successfully. I'm not saying this would work in your case but a visit to the CAB could throw up some useful information. Just my opinion...nothing ventured nothing gained and all that.

As many of you know, my wife went back to work last week after 18 months sick.

Well over the weekend she developed a nasty rash over her upper torso, She suspected it might be shingles. On monday she went into work and had a word with the clinic manager who had to check policy with the Occupational health dept. So long as the blisters are covered there is no problem. and after all as a hospital you don't know what the patients you are seeing in clinic may also be bringing in etc. To confirm it they took a blood test. On Tuesday the GP phoned to confirm the blood test results

Two of her colleagues refused to work with her, she was excluded from the staff room at lunch time and had to eat alone in the kitchen. she is on a 4 week trial of her new job and doesn't want to be throwing sickies. she is now worried her manager may have a dim view of her as being susceptible to illness due to her compromised immune system etc.

I'm not saying everyone who has a bad back, or has stress is lying, far from it. but when someone who you work with is on the sick with a bad back and you see photo's of them on holiday with full scuba gear on it
p!sses you off a bit to say the least. :toss: Nothing seems to be done about it and this makes the whole situation worse as others know they can get away with it.

I can guarantee it's not just your theatres that it happens in, as you say some people just know how to play the system, there used to be a guy here who never worked a full year in the 15yrs he was here, he did have a whole year off though at one point, we've even had a guy phone in to say that someone who was off sick from here was actually working for him, as he wouldn't give his name though nothing was done about it, the NHS is a real easy touch for those that want to play the system & like you it really pi55es me off at times, personally i can't remember the last time i had a day off sick but i know my boss would be fine about it & would want me to be fully fit before returning to work.

I am a company director and find that people are generally honest about illness / taking time off if the company treats them with respect and doesnt assume everyone is taking the p**s on every absence.
We like to look after our employees and have even paid hourly paid workers when they are not entitled to it.
I feel it is important to maintain skill base and treat people as assets rather than P**s takers.
I know this isnt the case in all business and many managers are on the "in these bad times" bandwagon to suit alterior motives!
Health comes first!

Health comes before work, if your boss cant see that then quite frankly he is a muppet, I know times are hard, but if you go back before you are recovered properly, you'll delay the healing process and mgiht end up being off for longer. Also what about being covered by insurance etc when your driving one handed ?

Dont feel guilted into going back to work. Listen to what the Dr's tell you rest up your arm and get well. Go and see your Dr and get him or her to sign you off sick, then theres nothing your boss can do about it, and then he can blame the Dr and not you.

Similar story to mine that Fizz. Dislocated left shoulder on Jan 4th... month off work, fracture clinic, physio... on-going. The difference is I got 12 days CSP, 5 of which discretionary (7 std) and a bit more on SSP.

Back at work, but not traveling as I should be for the current project... riding the bike though. :D

And +1 - in terms of bosses attitude. No-one tries to be ill or injured... these things happen. If you're boss has a different view - m*ppet....

I'm not allowed to still. I have physio tomorrow so I'm going to ask about it again.

Physio was concerned if I fell off it, I'd damge the wrist again and maybe damage the area around the plate and it'll set me back to square one.

Its so frustrating, especially on Sundays when I can hear bikes going up and down the roads
