Just had an off - Advice needed
 
I just got hit off my bike while I was filtering between 2 lanes of traffic.......classic case of car in lane 1 going to change lanes but not checking for bikes. I was going about 15mph.

The bike's ridable but looking a bit worse for wear (screen and top fairing smashed, exhaust system knackered)....her car (brand new peugot) looks a state on the offside.....wing dented and scraped, bumper ripped off etc.

I've got her details and a couple of witnesses (two firemen)....question is do I tell the insurance company immediately or wait to see if she offers to settle privately? I'm full comp with MCE so it should be pretty painless [-o<

Fear not, no taxis were hurt this time :D

not sure on how the insurance will see it fault wise (yes i know its legal to filter but they may say you should have pre-empted it) but i would always notify them asap so they don't get ****y with you when she does, which im sure she will being a brand new car!

tell your insurer straight away and give them all her details.

theyl contact her etc an then its up to her if she pays you or insurance.

when i got my car bashed i rang the insurance and said i only want to claim if the other bloke admits fault otherwise i wont botherso they just notted it on the claim

Hope your OK! Your poor bike!!

Did she give you any indication that she was thinking about settling privatly? If not I'd tell my insurers straightaway.

I'd inform the insurance company straight away if I were you, but then, that is just what I would do.

if i ever have a bump i'd inform the police and go down to A+E as it's the only way to get truth from these things it seems. Don't forget photos and start a diary as it's easy to get confused.

Tell your insurance company ASAP, you have witnesses etc. Has she admitted fault?

Glad your okay! If your wanting to see if she settles then I woul inform the Insurance company but make certain that it is not processed as a claim until you advise them to do so. A simple call to the insurance company is part of the claim process! and could possibly mean a loss of any NCB even if the claim is not taken forward.

I have been in this situation before. The third party wished to settle outside of insurance company. I agreed. That was until I gave the quote for the damage. They then very quickly changed their mind. I never told my insurance company for two weeks. When I explained the delay they did not bat an eyelid. Not saying it will be the same for you but that was my experience.

Well, I called the insurers and they are going to process it. Because of the damage to her car I doubt she'd want to go privately and my insurers reckon that she's at fault, especially as she admitted liability at the scene (I know that doesn't count for much these days but we'll see).

They also mentioned that my bike is probably a write-off because of it's age, but they have given me the option to choose my own garage for an estimate. I reckon I could have it back to normal for about £500 so I'll have to see if they will allow me to buy it back. I got offered a hire bike too but I don't know if it's worth gettting because if I'm found at fault (which I shouldn't be) I'll have to foot the bill as part of the claim.

As the gang said, get the insurance involved. You got indpeant witness that should help, also them that she admitted fault at the scence, were you hurt at all?

Search for LynW's letter on this site - buried somewhere. 'tis very good on this issue. It is true that you should have been aware of the risk, but then you were only travelling at 15. The driver was the one making the manuevre and so should have checked that the coast was clear...it would appear as though something went awry. Find the letter and make your mind up. If it was me, I'd have no hesitation in informing my insurance company...what with all the damage to my lid, clothing and all aswell as the bike.;).

just to make you aware there are some dishonest people out there!!
when i was around 20 im now in my 50s i caused an accident agreed to settle and told the other party get it fixed and i will pay full cost and ill pay the bill LOL
when it was fixed i said what accident?
im older now but say to you go through the insurance straight away dont mess around that is what you pay insurance for

Bikers League Defence offered me a hire bike - they were willing to take the risk of the 3rd Party's insurance not paying based on the details of the accident.

Glad your okay and think you did the right thing getting the insurer's involved straight away with the amount of damage involved. If you're talking several hundred pounds worth of damage to both vehicles it makes sense to let the insurance company handle it as that's what they're paid for and getting it settled privately is a risk unless you really trust the other party to pay up.

Let the insurance company sort it out and make sure you give them the details of the witnesses.

I had a similar accident, just rang up to put a note on my account then told them not sure if it'd be settled privately so just put it on hold for now and keep them updated.
Remember the cost of the bike, fairings, lid, clothing ...it's unlikely anyone (especially if they're over 25) will opt for settling this privately just don't let them uin your chance of a claim. filtering has a chance to go partial blame though so try to settle it with her if you can.

I've got the bike in for a repair estimate, and more damage has been found in the light of day so I'll have to see what that comes too and what the buy-back cost will be if they offer it. I'm also holding back on the hire bike until they can confirm that I won't be liable for any costs.......the last thing I want is to have a massive hire bike bill if this doesn't go my way.

I'm weighing up buying the bike back against letting them have it and get something newer. Of course it all depends on what they offer me as I've got a £400 excess and I've had a lot of work done on the bike.

My lid doesn't look damaged either, neither does my jacket, but my gloves are scraped-up so I'll I'm going to have a closer look tonight before putting a claim in.

It's a massive PITA but hopefully it'll all be sorted relativley quickly. My left arm is aching a bit today but that's the only injury I've got by the looks of it.

Yep, she admitted it was her fault at the scene and said sorry on more than one occasion. I told the insurance company this but I've got no proof (couldn't find the darn record button on my phone!) so I'll have to see if this counts. I'm pretty sure the firemen said to me that it was her fault too. See looked like a newish driver, but knew exactly which details to give me so maybe she's been in this situation before?

Rememeber there can be invisible damage made to the armour in stuff. Most important though: has the lid had a knock?

If its 100% no fault insist on return to showroom condition :)

If it is her fault then you should not have to pay the excess. The excess applies to claims made on your insurance policy, surely you will be claiming against her insurance? (that claim being handled by your insurance on your behalf.)

Your excess will be taken until the cliam is proved non-fault, uyou can then use your legal cover to re-claim this and and damaged kit, injuries etc,

Indeed, but as she hasn't admitted liability yet I've been told that technically it's a claim on my policy and then the costs are recouped by my insurers from her insurance company if I'm found 100% not at fault. I think that this is how claims usually work, but I'm happy to be corrected on this :confused:

The bugger is that this could drag on for 3 months and I'd be out of pocket until the whole thing is sorted. Hopefully being fully comp will pay for itself on this occasion.

See above hun ;) (but yes thats right, you lose your ncb-unless its protected and you pay out the excess-all that will be re-instated if they claim is proved to be non-fault)-be warned it can take awhile (years even), im lucky mine took a few months but my pa claim is still pending
