On the way home tonight and a guy in an MG decided that he didnt want to wait in the traffic and turned right in front of me, I was filtering at no more than 20mph but still couldnt stop in time and clipped his rear wing and fell off :smt089 snapped my clutch lever, brake lever, smashed indictor and loads of scuffs , I have a bruised knee, an aching right hand and a stiff shoulder so I was very lucky. Insurance getting me a courtesy bike and arranging for my bike to be repaired (even though I am 3rd party F & T because I have some legal expenses cover or something with e-Bike).

The only thing that dissapoints me is there was another biker not to far behind me, nodded to me at the lights just before it happened and he did not stop #-oI know there is no law that says fellow bikers should look after each other but I know for sure I would have stopped

Ah well, at least I am OK and the bike can be repaired.

a witness helps big time in this situation but ppl dont seem to want to get involved :( my witness never answered any letters my solicitor sent them and they are the only ones that saw my off :( them no being bothered look like its going to cost me 2k :( sorry to hear about your off mate, chin up ay it could have been much worse :(

If I saw a biker knocked off I can guarantee I would be there in court if required. Disappointing that he didn't even stop let alone offer to be a witness.

Bad luck mate, big shame about that biker, but I guess if your insurers are getting you courtesy bikes and all that they must think you will be claiming off the other car's insurance no?

Unlucky fella. It'll proably hit you more in the next few days (trust me, I know :(). So off to the quacks & get yourself checked out, then take it easy!

Surely you are undertaking or something? I saw an accident identical to yours once, and i was pretty sure the biker would have been in the wrong.

Would you filter past police etc?

I was told on my DAS test by my instructor that if I didn't filter past traffic, I was therefore not making progress, and would be marked down accordingly. Do that too many times & fail your test.

Undertaking is the art of passing a vehicle on it's left. If the car tried to U-turn into stephencassidy, you have to assume he was riding to the right of the car. Also, undertaking is permitted by the highway code, so long as traffic to your right is "stationary or moving slower than you."

Would I filter past police? Before I put the scorpion on the bike, without question. Now I'd be a little more hesitant. I probably still would, but very gingerly.

I did think that about my fuel can with no baffle lol...

I seem to have a knack of knocking it up a couple of gears when riding past coppers - keeps it respectable :D

Pretty similar to my accident last year. The other party have offered me 80:20 so fairly sure I could get 100% if I really want. You're lucky it could have been worse - I broke my collar bone and the bike was written off.

Try searching for topics by me and you should fine the one where I detail the letter that describes how car drivers are in the wrong in this case. Short answer is manouvers like that must be preceeded by correct observation and then as they are being overtaken specifically prevented from blocking the path of the vehicle performing the overtake. Case law suggests otherwise - of course, but it's not too bad I believe.

Highway code also says Mirror, Signal, Move. Common sense (not that car drivers have any) also says a shoulder check for blind spot.

Did the car indicate before pulling out? Just a thought...

Only reason I am apprehensive about it is because police tend to not know the law on filtering and think it's illegal - it's not worth the hassle of filtering.

Doesn't mean it is illegal, though (it isn't).

I take it as a personal challenge to educate Plod.

If they want to give me a ticket for filtering, that's fine. But they'd better make sure they know the law that they're enforcing when they do.

I'd politely ask them to explain at the scene, then accept the ticket, and appeal it. That would cause a lot of paperwork, some of which might happen to land on the desk of a local paper.

I don't think they'd make the same mistake again!

I wasn't undertaking I was filtering along the outside of the stationary traffic which according to the highway code we are allowed to do with caution.

I spoke to the insurance (e-bike) and even though I am third party they are sorting out bike repairs and a loan bike because I have some legal expenses cover? I also asked about my gear and they said that will be replaced too. Fingers crossed for a painless resolution.

Thor, the car was deffo not indicating as I approached as I would have slowed down and prepared to stop, he pulled out and indicated at the same time (and to be honest I think he was pressing buttons on his tom tom but couldn't prove otherwise). I think he pulled out, I hit him, then he indicated around the corner.

I filtered past police traffic car about 10 or fifteen cars back. They just drove on and left me to pick the bike up :smt103

The trouble with filtering on a bike is that you are deemed to be overtaking. By doing so you are accepting a certain amount of the risk if there is an accident (apparently)

Overtaking is a dangerous manouver, yes. So there is some duty of caution. The chap that pulled out in fromt of me said he was avoiding an obstacle in his lane. Presumably one I couldn't see due to the stationary cars around it. Either way, I see that as irrelevant. He still moved out into my path.

I suppose if you can show that you were riding sensibly and not like a knob then you should have a good chance. I expect you'll be getting a letter from a solicitor's firm soon!

Sorry to hear about your off, good that you were not hurt too bad.

Hopefully its all kosher but tread carefully on the courtesy bike and repairs. I am fully comp with ebike and I did not get a courtesy bike after my off. I did get a completely seperate company phoning me (tipped off by ebike, but when pressed they admitted they were nothing to do with ebike) offering me a bike, and they said it was free as they would claim off the other party. But that assumes the other party will be held 100% liable, which is a big assumption. I didn't go for it as I figured they'd stiff me with the bill if I was found liable. Maybe you have someother deal?

ebike just telephoned. Third party is not accepting liability, looks like its my word against his :-( I have faxed them a letter (taken from my posting on VD) stating the facts about filtering and turning right without indicating from stationary so fingers crossed that may do some good otherwise it will be a 50-50 claim.

Just contemplating popping into the police station near the accident scene just in case any witnesses telephoned and left any details there.
